Unfortunately BOS seem to push it to going to court, if you are at that stage as IZZY says you can then ask the Financial Ombudsman to take over your claim.

Have a read of the thread regarding Claiming while bankrupt here...

As regards your list/spreadsheet of charges this should be accurate as the banks can and do check what charges you are claiming and should your claim go to court, this list will form your defence.

Having finished uni with the obvious debts I belive I am on top and slowly (yet surely) getting rid of them.

The problem I have is that I know I have collected bank charges throughout college and uni and I am on the verge of sending off my letter to Barclays to recieve my charges... BUT...I have a overdraft of £3000 and the last thing that I want to do is fight the bank, win or lose and them then closing my account, putting me up s*-creak without a paddle.

I hope someone can give me a insight of what may happen? Shall I wait a little longer until my debts are smaller or go ahead now?

I heard that banks are forever trying to get around paying back the charges and the last thing I want is them to get away with the money which is mine!

    Thank You

Hi, to cut a long story short I have got to the final stages, we have gone through the MCOL (which cost £120). We have received a letter from the bank today saying they are sending us a cheque for £750 within 10 days which is a full and final settlement. We are not happy with this, the original claim request was for over £1000 (inc interest). What do I do now, somebody please help we are scared. Please can somebody explain in simple terms what to do next, it would be very mch appreciated.

I followed Martins Templates, posted my letter and list of charges for the last 6 years £2,600, on the Saturday. First Direct replied on the Tuesday offering £1,200. The question is to accept the offer, or push them all the way

Push them all the way, the money is yours not theirs!!! Read this link here

Hi, I think I am at the final stages of reclaiming £1400 from LloydsTSB.
I wrote my first letter back in December and a month ago was seriously disappointed to recieve a court date of 29th June!
However I recieved a letter from Lloyds solicitors offering me full and final payment, with instructions to sign the letter and send it back and the money would be credited to my account.
They would of recieved this letter on 16/4, and obviously I have been checking my account daily but still the funds havn't been paid in.
I have called the solicitors many times but keep getting the same response- "As we have such a high volume of payouts to process we cannot give you an exact time you will recieve the money but it should take 7-10 days after your claim is processed."
Its now well over 10 days since they recieved my signed letter, is anyone else in this situation?

I decided to pursue my claims agains tLTSB and LLoyds with the financial ombudsman and on Monday received a letter from Clydesdale stating that they are having dificulty tracing my (closed) account but if I provided them with a bank statment they would isue a cheque in settlemant of my claim.
However today I have received a letter from the FOS stating that both backs are defending their charges and the FOS will need to lok at each charge and decide if it was fair. They have said they will contact me again within one month. I am now thoroughly confused. has anyone else had anything like this when dealing with the FOS?

    HI,
I've recently sent off my letter to HSBC asking them to repay all default charges totalling £1378 and asking for a full response within 14 days.
However I've not had a 'full response' I received a letter advising me they are looking into the matter raised and will contact me with a full response as soon as they have completed investigations. They also enclosed a leaflet called 'listening to your comments'.

I'm unsure what to do next, should I stick to my 14 days demand timetable and write again demanding they pay up or I'll begin court procedures. Or should i wait a little longer for them to come back to me with their comments? Its now been 16 days since I last sent my initial letter so I know I need to decide what to do quickly.

    Thanks for any help!
