Forgot to say also Lloyds TSB is the bank and they acknowledged the claim and stated that they intend to defend all of this claim.0

You have two options: Refuse the cheque and send it back, saying you are not prepared to accept anything less than the full amount + court costs.
Or you could bank the cheque and send them a letter like this:
"I cannot accept your offer of £xxx as full and final settlement of my claim. I will accept this as part payment and without prejudice, but will continue my claim for the balance. I have made a reasonable effort to settle this claim before issuing a court claim, but you ignored my efforts to settle this. Seeing as I have now had to issue a court claim because of your failure to deal with my claim in a timely way, I will now settle only for the full amount of charges + statutory interest + court fee."
In this case you will need to inform the court that part of the claim has been paid, and amend the amount you are now claiming for. I am not sure what that entitles though.Reclaimed thanks to this site:

I wrote a letter to Woolwich last month to reclaim £660 back in bank charges. I received a confirmation letter, then today a letter with an offer of £735 to be credited into my account. The only reason the account is not closed is that I had an arrangement to pay £5 each month to clear the debt. If the money was credited into my account then it would only leave me with £75 clear. I don't want this to happen and want the money in the form of a cheque. There was a reply form with the letter and an envelope and I accepted the offer but put a letter in stating that I wanted a cheque sent for the amount and to close the account. Have I done the right thing? Please help.

I followed Martins Templates, posted my letter and list of charges for the last 6 years £2,600, on the Saturday. First Direct replied on the Tuesday offering £1,200. The question is to accept the offer, or push them all the way0

Only you can decide if you want to push it further. Perhaps a phone call to negotiate might do the trick or failing that you could claim through the courts. For the sake of £120 (if you can afford it of course!) and a few more weeks you could have it all back.0 -
Sent the second letter to LLoyds TSB 2 weeks ago, saying I would settle for a slightly lower amount (14 days was up monday I believe) No response. What now? I think I need to wait til next payday (25th) before I can do MCOL, cant afford £120 at the mo. Does it matter if I delay a bit? Worth waiting to see what happens in the mean time?0

Can you tell me how much first direct charge for the list of charges? How long did they take to reply? Thanks.Trace - I have a claim in with First Direct for just over £8000. I whacked it all in one go on MCOL and it was accepted and processed. FD have since acknowledged and stated their intent to defend. Am waiting to see if they stay true to their word. I don't know if I should have done it this way, but I have.
I can however, tell you that it will cost you £240 to file a claim that big on MCOL !!0 -
Can anyone give me some advice? I went bankrupt and I am now discharged (unfortuately MSE was not around then or things would have been different). I owed some of the banks money when I went bankrupt, should I, can I, go back and reclaim bank charges as I may not have needed to go bankrupt! Would they offset what I owe them?... does anyone have any advice about this and is 6 years as far as you can go back?0

Amount they paid: £1249.03
This took up to a week before the court date for a summary cause in Scotland against Abbey before the paid out in full. Hope this gives some hope to others in Scotland to get their money back. Seems these claims never get to court but don't be scared to stand up and fight for what is yours and not the banks.
A big thanks to this site and for those who run it for helping us all.

i have just started to claim against cahoot, i have sent my first letter claiming £2500!! Not too sure of court system in scotland, small claims seems to be for max £750, but i see you calimed for more please advise thanks0
