Hi,
I have just got a letter back from moneyclaim as the 14 days have passed for Natwest to respond,they sent me a letter yesterday saying that they will pay out £1200 instead of £1800,so I declined,The letter from moneyclaim states that the defendant (natwest) has until 15th May to file a defence,I called moneyclaim and they said that they WILL file a defence! What does this mean? Will I now lose? Should I have taken the offer? Will I have to pay court fees? Very worried?????

Hi again, i've filled in the template letter requesting my charges back. Do I have to send statements showing the charges with this or can the letter go alone. As I had searched mine online for the past 5 years with Lloyds TSB and I could only search 3 months at a time it will take me an age to print them all off

Hi,our claim has been going on for some time.we put in a claim for £5000.The bank has put a defence in,im really panicking now.We received a notice of transfer of proceedings basically telling us that its being transferred to our local area.The bank is stating that when we opened that account we knew the charges and by remaining in credit we may avoid most of the charges,that their is no breach of contract, so the charge cannot be a penalty.That the customer is given advanced notice of charges being imposed.Also that the charges are fair and reasonable and denied that they are unlawful.That the customer is notified in plain intelligable language at the conclusion of the bank.That the chargesare for banking sevices and are not damages or penalties.The bank is entitled by contract to impose these chargeswhich they class are fair and reasonable.It is denied the charges are unlawful or contravene any statue or regulation.Also that the claims based on charges in my account is prior to the six years from issue of the claim,and that the particulars of the claim does not show how the amount claimed is arrived at.And finally that the claimants claim is denied in its entirity.Quite scary stuff.Ive got this far and im not going to back down.Is anyone else at this stage or ahead of this and can give me some advice.And what do we do now,as far as im aware i should receive a questionaire.Please can someone give some insight in to what happens next and what needs to be done on my side of things.Ive never been to court before.Thanks Jackie0

Did you work out the charges on Martins bank charge calculator? If so, you need to print this and attach that to the letter, you dont need to send in the statements. Hope this helps0 -

No I didnt I went through all the statements online and searched the charges every 3 months over the past 5 yrs and wrote them down then I used the calculator for the interest,

Hello all,
I have started a claim against Nationwide for £957.00 of charges through MoneyClaim online. I have had a reply today saying that they are defending it.
Is this the normal next step?
It says they now have 28 days to put a defence in.
Any advice please.

Don't Worry!
This is how the game is played Remember no bank has succesfully defended their charges at court and very few turn up.
They may put in a defence again this is a scare/stalling tactic. They are playing for time.
Keep calm take a deep breath and if you need reassurance the success stories thread always helps me remember why I am doing all of this.
Remember everyone here will give you support so stick to your guns0 -

I have not filed with MCOL and am waiting for HSBC to ring back to discuss this offer.

Use the calculator on this website, its on the same page as the template letters or you could type the charges on your own spreadsheet.0
