I haven't heard off HSBC so fully expect to use MCOL when deadline is up 7th May! My question is - my claim is for £9922, so as this is not small claims, how much do I have to pay or is there anyway I can do it in 2 claims?

Smile are on the ball. Having received my list of charges over the weekend, I promptly sent off the 1st letter asking for a refund of my charges etc.
Today I received a letter back from them stating:
'I'm sorry you've felt the need to make a complaint. This is just to say that we'll be looking into it and a member of our Complaints Team will get back to you with a full response. This will be by phone, secure message or return letter.
However, as we're regulated by the Financial Services Authority I do need to make you aware of our complaints procedure.
If you go to our website, click on "talk to us", complaints is in the left-hand menu. Here you'll find our full procedure'
The question I have is if anyone here has had dealings with Smile, whether this is normal for them and what generally happens next ?
Are Smile one of the easier banks to deal with in regards to reclaiming bank charges ?

Your best to put in two seperate claims as the maximum you can claim in england is £5000.
Don't worry if you go through the success thread there is someone who has successfully done this.

Trace - I have a claim in with First Direct for just over £8000. I whacked it all in one go on MCOL and it was accepted and processed. FD have since acknowledged and stated their intent to defend. Am waiting to see if they stay true to their word. I don't know if I should have done it this way, but I have.
I can however, tell you that it will cost you £240 to file a claim that big on MCOL !!Reclaims in progress:

Cheers for that! That's ok £240 I can cope with if it might mean I can get £9k back! No wonder I couldn't get myself out of debt! but i did bury my head in the sand! All I want is my money back & for it to go in a savings account! I did owe lots of money all over the place, so could claim i suppose off them, but to be quite honest i can't remember most of them!! All paid up now tho, so i would be content with the bank paying this back to me. I'm not backing down on this one! If any one can help having problems with natwest phoned this morning saying there is a offer on there system but been waiting 6 weeks now and keep getting fobbed off if anyone can help please send me a message i dont want to do court action incase they defend0 -

Yes you can claim for excess overdraft fee.
You can either send letter to one of the addresses on this forum or just hand it in at your local branch and ask for a receipt of the letter being handed in.

Hi,
I have just got a letter back from moneyclaim as the 14 days have passed for Natwest to respond,they sent me a letter yesterday saying that they will pay out £1200 instead of £1800,so I declined,The letter from moneyclaim states that the defendant (natwest) has until 15th May to file a defence,I called moneyclaim and they said that they WILL file a defence! What does this mean? Will I now lose? Should I have taken the offer? Will I have to pay court fees? Very worried?????
