Let's put it this way - log into moneyclaim tonight, and if it still says "Acknowledged" instead of "Defence" and if they let you order judgement, that means you are safe.

Its up to you really - if you feel you cant spare the time to do this yourself BUT you must remember this is YOUR money you are asking back and this company - or any other company - will charge you for this. I have never had anything to do with claiming and small claims courts before but I have followed the templates and asked questions on this site and everyone is SO helpful. I would say go for it yourself and simply follow the instructions set out clearly on this site. I have three claims going through at the moment. One of them with NatWest has been defended and I have a court hearing date of 4 July. Yes, its scary and Im hoping they will pay up before I have to go to court but its MY money and Iv got to the stage where I think - to hell with it - bring it on!!! Look again through this site - everything you need is here - save YOUR money and go for it yourself! Just my opinion!!! JayneG

HSBC - sent 14 day - still waiting for reply. MCOL by end of week - claiming 795 - eventually paid out £560.

Halifax - sent for statements Feb - cheque cashed - nothing received - reported to FSA - paid up almost amount claimed before official complaint registered with FSA

I did mine to head office, I think you have to use the head office when doing your claim to court?

    hi peeps

just about to send my first letter to capital one, this account is now closed i managed to pay it off last year, problem is i cant find my account number. Is this a problem?? can they go by my postal address??

    would appreciate your help thanks!!!!:

I was in the same postion with Cap One. I phoned their customer services dept and asked them for my account number. After completing several security questions (name, address, DoB, shoe size - well that might be an exaggeration but you get my drift...) she told me she couldn't tell me it over the phone (but she could tell me what my last transactions were!!!!) but she could send it to me through the post. She then said did I just want the account number or did I want a copy of all my statements? Ooh - statements please! She asked me how far back I wanted to go and I said since inception of the account (over 3 years ago). Ok she said no problem but it could take up to 21 days for me to receive them. I asked if there was a charge and she said nope! True to her word about 3 weeks later they dropped onto my doormat. HOWEVER - when you get them check them carefully - I'm still waiting for one statement from April 2005 and the same from 2006 - have asked for them (again rang them and they said they'd pop them in the post for me but again it could be up to 3 weeks).

The bank are within their rights to take any money owed to them through debt prior to them paying any money they owe you I'm afraid. Think of it as clearing the debt and not having it hanging over your head for ages.
  • Jayneg, I recognise the name but know nothing individually about the company you mention as I run a competitor company that deals with financial services mis-selling and bank charges etc etc etc

25% is too much for this service. It should be no more than 10% plus VAT if applicable. As many posters on this board will testify it can be done by you as an individual without a firm getting involved so it is really a question of time and hassle. Just like employing a plumber, do you want to read the book etc or get the plumber in and bite the bullet to pay his bill
