  • I've gone through my last 6 years worth of bank statements from when I had an account with Barclays and the unfair charges add up to £600 so I want to make a claim. But....... I no longer have my account with Barclays - does that matter? Also where do you send the letter to your branch or head office?

  • I'm struggling with Abbey too. I was initially daunted by the lack of Abbey posts, and the time it seems to take. I received today, a letter from Abbey outlining the defense they have submitted. I really didn't want to get this far.

    If you no longer bank with them not a problem you can request specifically that they send you a cheque. If you check the results thread this seems to not be a problem with most banks.

    YOu can send the letter to either its up to you the branch will record it and forward it on anyway.

    I sent a request to M.B.N.A for my bank charges totalling £500. Then L.B.A . Due to file court claim this coming weekend, but something odd has happened!! I received a letter from M.B.N.A this morning saying thanks for asking for a list of all your charges (i hadn`t as already had statements), they total £716 pounds. Do i have to start at the beginning again? i don`t want to lose the extra money. Can anyone advise please? thanks x

    All These Success Storys Really Upset Me As I Have Over £3000 With Tsb And They Have Told Me I Claim Them Back As They Are Not Default Charges They Are For Going Over An Agreed Overdraft, Is This True Or Can I Still Fight For This Money It Would Help Me So Much And I Have Never Done This Before, Please Help What Can I Do...

    Yes you can claim them back as they are unfair charges . These are just dirty tricks to try and scare you off before you start :mad: . One thing i would add is make sure that you open a backup account first . I am in the middle of a claim with Norwich and Peterborough and they have frozen my overdraft facility and have stoped my d/d's :eek: . Keep going , and Martin thanks for advice after too many years i can finaly see the light at the end off the tunnel

    If you have has an overdraft for quite an number of years,can you still reclaim the charges,(my apologies if this has been asked before).

    As i'm not too genned up on these things,do the Royal Bank of Scotland have ALL their total charges on the left hand side of the page,thanks for any help.

    Hi, I have issued numberous letters to american express and the pre court letter recently. The have sent me a reply, stating that because the card is (was) a corporate business card it is different from a consumer credit card. I said to them on the phone that the charges were approx £283 per month, which me as a consumer was paying not a company or business. The total claim is for approx £2660. Can i proceed with court or it it correct a corporate account is different. I really dont know what to do now, and worried that if I issue court that they are correct.

    I have just received the following email from the Information Commisioner regarding the complaint I made to them regarding Natwest's breach of the DPA 40 day period for supplying the details pertaining to charges.

    "Complaint about the ‘Subject Access Request’ made to Natwest Bank for personal information relating to xxxxxxxxx.

    Thank you for your correspondence dated the 20th of April 2007.

    You have complained that, as yet, the information requested from Natwest Bank has not been received.

    When we receive a complaint like this, we are under a duty to consider if it is likely or unlikely that there has been a breach of the Data Protection Act 1998 (the Act). We will then decide what action, if any, to take.

    Following a recent Office of Fair Trading decision about ‘penalty charges’ we are aware that the number of individuals making subject access requests to financial institutions has significantly increased. However, clearly these financial institutions are still required to comply with subject access requests within the statutory 40 calendar days.

    As you may be aware under the Act there are eight data protection principles. These are sometimes known as the principles of good information handling as they set out the way organisations should handle personal information. The sixth data protection principle requires organisations to process personal data in accordance with an individual’s rights under the Act. Therefore if you have not been sent the information you are entitled to within 40 days, it is likely to be in breach of the sixth data protection principle

    We would like to explain that due to the number of complaints we are receiving about failed subject access requests we are writing to financial institutions on a monthly basis, sending them a ‘batch’ of complaints.

    We will be writing to Natwest Bank with the next batch of complaints at the end of May 07 and will of course include the details of your complaint in our letter. We will advise Natwest Bank to ensure that they provide you with the information you are entitled to as a matter of priority. Furthermore we will ask them to outline what steps they are taking to ensure their future compliance with the Act. Therefore although we will now close your case we would like to assure you that we will continue to carefully monitor this issue.

    Finally, it may be helpful to explain that a breach of one of the data protection principles is not a criminal offence and we cannot punish an organisation for a breach of principle. Our priority is to get organisations to take steps to solve the problem and to ensure they handle personal information properly in the future.

    However, it may also be helpful to explain that if you have suffered a loss because an organisation has broken the law, you may be entitled to compensation. We do not have any powers to award compensation and any claims should be made through the Court.

    We would like to thank you for bringing this matter to the attention of the Information Commissioner.

    Please quote the case reference number from the top of this letter in all future correspondence about this matter. Failure to do so may delay the processing of your complaint.

    So it would appear that it is a 40 calendar period and not a 40 working day period and that Natwest have failed on this.

    Although there doesn't appear to be alot that the Information Commisioner are doing apart from giving them a slap on the wrist.

    So I will be adding a claim for compensation for stress and anguish and cost of letters and postage and anything else I can claim for when I fill in my MCOL claim on Friday.
    Natwest - LBA sent 26/04/07, FO. Sent email to Michael Duncan on 11/05/07. SUCCESS - Offer letter received 19/05/07 for full amount.
    Natwest Credit Card - 1st letter sent 27/4/2007 (£294) SUCCESS - Full amount repaid
    Capital One - 1st Letter 03/2007, FO in Sep 07. SUCCESS full amount repaid Jan 08

    just to let you know my bank charges claim against ABBEY is still ongoing. they owe me £4670 a couple of weeks ago they decided to offer me £815 which they put into my bank. nice of them!!! BUT not nice enough, as if i was going to accept that!!!!!!! so i sent my complaint form to the financial ombudsman. phoned abbey this morning and said it may take a further 4 weeks. QUESTION: if they still dont offer me the full amount do i take them to court? and if i do take them to court how do i go about it??????
