Just reading the above message and thought could you use this in defence.
I.e As charges have to be in proportion. How can some accounts be charged less then others. What would be the difference whether the above account went over his overdraft by £5.00 and someone else going over by the same amount and being charged £35.0 -
Hello,
Can you help answering a question,
2nd letter to lloydstsb asking to refund my mothers bank charges within 7 days or will proceed with court action. this was 14 days ago, but not heard anything from them yet?
1st letter demanding refund charges, got letter from them back saying their charges were to company policy etc, seek advice through oft.
sent 2nd letter from link- template to acknoledge they still have unlawfully made these charges to refund or will proceed with court action.
is this normal not to hear from them at this point or are they waiting to see if I carry out with the court action.0 -

Hi
They don't always reply, just make sure you have given them 14 days, and then start the Court action.
Good luck!

ok i finally took the plunge and sent the first letter to natwest, i have sent it to the address elsewhere on the forum.i sent it 1st class but have since read that i should have sent it rec delivery, should i canx the cq and resend it? or will it be ok?and is the 40 days 'working days' or 'actual days'? ie send mine today so should be back by 13 Jan?'Children are not things to be moulded, but are people to be unfolded'0

I had an arrangement with Nat West to repay my overdraft, Nat West reneged on the agreement and are now threatining ME with court action.
I have followed the advice on this site in order to reclaim my charges, and i have already recieved a list of the charges they applied to my account over the last 6 years, but instead of Me threatening to take them to court, im already being taken there
so what i need to find out is....
shall i just follow the advice as though i were taking the bank to court, but use this as my defence.
I have the form of defence to send back to the court, which has a small claims section and the amount i dispute.
So shall i defend myself with the small claims option and the total amount of charges, and is this then the same as if i took the bank to court?

I sent my letter requesting the 6 years transactions by first class post forgetting about recorded delivery, I was in a rush at the time. I took it as 40 days not 40 working days but I could be wrong. I sent mine 30/11, so still waiting.“A budget is telling your money where to go instead of wondering where it went.” - Dave Ramsey0

Hi
It's 40 actual days. Why don't you give them a few days, then ring them to see if they have received your letter?
Good luck!
