Hi Guys
I previously had an Advantage Gold Acc with Natwest, which has now been frozen since aproximately Nov 04 due to the debt I built up on it!
I have been currently paying back the money to the bank to clear off the arears, but since seeing the item on BBC Morning news (Dec 1st), I was wondering is this also a case I can fight to get back the excess charges I was hit with?
I had an agreed £1000 O/D , but due to circumstances I was over my limit and forced on a quite a few occaisions to use my Cheque book and cheque gurantee card to draw maoney to live on/paybills etc...
Each time I cashed a cheque I was charged £30 by the bank, and in the end the account was frozen with a balance of aproximately £3200, aproximately 1/3 of which is made up of charges for the guaranteed cheques plus also missed D/D charges, Unauthorised O/D charges etc..
Is this still a case I can take up, considering I have allready agreed to pay back the money with a re-payment plan?
Any advice would be most welcome

This might sound like a stupid question but HSBC have charged me an extortionate overdraft fee every month for the last 6 years - can I claim that back or is just excess overdraft fees you can claim for??

I have been receiving charges for the past 3 months which has consequently snowballed not allowing me to pay any DD's for these 3 months. The same happened today with my DD's so going to get more charges.
Should I wait until my account is back in credit before putting in a claim for charges or can I go ahead and do it now as im in a catch 22 situation. I cant see me getting back in credit until I get the money back (fingers crossed) that i have already paid out in charges.

I called Lloyds and Barclaycard today, just to see if they'd received court summons. bothy banks have passed it to their legal teams. Barclaycard i think will go all the way. Not too sure about Lloyds as they had to look at it as not on system yet! If after 14 days i've not heard anything, can i win by default? Or should i give them some leave way?0

I Contacted Abbey And Sent The 1st Letter Asking For Charges For The Last 6 Years. They Took Their Time Getting Back To Me But The Most Annoying Thing Is That They State " Unfortunately We Are Unable To Supply A List Of Charges Applied To Your Account For The Last 6 Years Because We Do Not Store This Information Seperately From The Other Transitional Data. Most Transactional Information Between 2000 And 2005 Have Been Archived Into Microfibre And Is Not Available On Their Computer.
I Have Written A Second Letter Informing Them This Is Not Good Enough...... Any Suggestions. Has Anyone Else Had A Similar Cop Out And What Do You Advise.

Hi, I asked this question before in the old thread, but I can't find the answer now - so here goes again. we have two accounts, bot of which have loans on them that we're paying off. If we have a go at the banks - Nat West and the Co-op, are they able to foreclose on the loans? That's what's really worrying us.

Yes it is a bit of a catch 22, but don't wait - start claiming now with a "letter before action" listing all the charges you know about and add a note that you will reclaim all unfair charges including any after the date of your letter.
Claim everything going back 6 years, if you don't have your statements, then send a "suject access request" first and get copies: this link gets you straight to a leaflet about this:

I'm not entirely sure how money claim online, or the small claims court can deal with reclaiming unfair charges that were "in the future" at the time of starting the claim. Clearly if the unfair charges are causing you to go overdraw regularly or permanently, then the knock on effect will be seen as unfair also - the judge will understand this so maybe you could include and estimate of monthly accruing charging. Do any other posters have better experience in this area???
You can claim interest for this situation, it is complex to work out but

I have a basic current account, joint saving account and mortgage with my bank (Halifax). My partner has a current account (with overdraft) and joint savings account, mortgage and a credit card with the same bank. If we both try to claim back our charges, can the bank shut down the savings, mortgage and credit card accounts as well as our current accounts?
Can the bank shut down our current accounts even if our claims aren't successful? If so, will my partener have to pay back their overdraft straight away?
Can we claim back charges for bounced direct debits?0 -

You need to go back to them and say that you are asking for all data held on you under the DPA and for that information you have enclosed the correct amount of £10.
Got my bank statements today?? bit of conflicting information but has saved me writing to them again. just about to send my letter asking for my money back..0
