    From reading the various posts I have found that people who get the reply that you have, wrote to your local bank or head office. You need to write to the data protection team. eg Abbey's is at Milton Keynes whereas their head office is in London.
    If you go back to Martin's original page on the site about claiming the charges there is a link that some lovely person has written out all the relevant data protection addresses for most of the banks!

    I myself have just sent the data letter out for myself and my partner.

    I have gathered that for the
    a) printout of charges - Data protection address
    b) actual request for money back - local bank
    c) going to court - Head Office

    I will gladly stand corrected if this is incorrect. Hope this helps!!

    Hi, some one answer me a question. Now i've submitted claim. How will i know if they have submitted defence? Will they write to me or will it say on money claim?

    OK on MoneyClaim you will see a change (it will change to 'defence') and you will get a letter confirming this. Then on MoneyClaim it will change again (2 weeks for me) to 'The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly.'
    You will get a form to fill in and you along with the bank will need to gather the information and get it to court - I think within 28 days. This is to waste more time hoping that you will pull out - you will get a court date, but just before the date you will get an offer from their solicitors!!!!

    I have been with Natwest for 6 years now, started it as a Student account. At the last count there have been over 1000 charges for unpaid items, going over overdraft limits, card misuse, charges for bouncing items. But I have a 2000 overdraft with them and I'm afraid that if they close my account ill have trouble paying it back or opening another. I worked out that in the last two weeks I went over my limit by £20 and have been charged over 200 for the consequences of only being paid weekly. Now I'm in a spiral. But I'm too afraid of losing my account. Any advice wouldbe gratefully recieved. Daft thing is I got paid the day after the overdraft incident but now have no money at all!
  • Hopefully the total you would get back from the bank would more than cover your overdraft of £2000?! Then it would be cleared
    Making the most of what I've got.
    I have now realised earning more money won't make me richer but clearing my debts will!!

    This thread has made me feel so much better about everything !!
    I truly believe that I will be able to claim back 10s of £1000s using this format !!! I have used massive overdrafts and high bank loans over the last 4-8 yrs and feel like I have been screwed by these big banks . In 1 yr alone ( 2000) I have guesitmated around £10k in unauthorsied overdraft fees , bounced cheques , unpaid dds . So all this week i am fine toothcombing all my old records of accounts to make this is a massive reclaim of these bank @@@@ers !!( dam i wish i could swear now ! ).
    I really dont know the right way to initially approach this as I know my overall claim will be big ( around £30-60k ) at a guess .
    So I will be keeping a close eye on this forum and keeping other people informed of my progress along the way as everyone needs to know the Banks little tricks and traits that will try and put you off doing this .

    i have just posed 3 letters 'Recorded Delivery' claiming charges back!

    Nationwide £ 1249.77

    Capital One £ 682.00

    Yorkshire Bank £2150.00
    (Yorkshire closed my account because i was £1500 overdrawn!!, has anyone had any luck with these, dont seem to see anything posted)

    Fingers crossed, im prepared to go all the way, it's bad enough them taking it but when they know they cant it's theft!!

    If its just a couple of charges I would perhaps phone first but obviously if its a lot of money always put everything in writing.
