  • hi can any 1 give me some advive just recieved my statements back after 41 days can i claim back any money that they have charged me eg. interest charged on a current account quarterly fees for atm use etc. direct debit set ups and referral charges. im in the middle of adding them up not sure if i can claim for them all.

    You cannot claim for interest charged on your overdraft as this is a service rendered you. Similarly I would suspect the direct debit set up fees and referral fees (whatever they might be?) would come under this heading too (but check with a Mod). Never heard of being charged to set up a DD before. That alone would be enough to make me switch accounts as most do it free!!
    Basically you can claim for any "penalty charges" which you incurred due to direct debits not being paid, cheques bouncing, insufficient funds in your account, etc. (Any time the bank was only entitled to charge you admin costs)

    Personally I think you have weakened your case by asking for 75% only. If you are prepared to go for the long haul you CAN get 100% PLUS the interest they charged on the charges, PLUS you can charge them interest (if it goes as far as a court case) on the whole amount (as you could have been earning that interest on the money if they hadn't taken it from you) PLUS any court fees

    However, if you're happy to barter for 75%, its totally up to you. Its your money after all. Just wanted to let you know what was possible.

  • Thanks for that bizzaro, I see what you are saying, I only said that as the guy I spoke to kept me bartering for the money, so I finished the conversation saying if you want me to settle today, I want 75%... But thanks for your advice, I will report what happens....

    Has anyone claimed from HSBC as I am still awaiting a reply from my first letter sent, sending the second one tomorrow.... cheers jasc

    I started the process of reclaiming backdated bank charges from Lloyds TSB back in August of this year for a total of £2,249. I have sent a number of letters and threatened to take them to court. However, all the replies I have had from them are basically saying I'm not getting any money refunded.

    My problem now is where to turn next. As I live in Edinburgh, Scotland the small claims court has limit of £750 and as my bank charges total £2,249 the option of taking them to a small claims court is not open to me.

    Should I enlist the help of a solicitor or do you think this would be a waste of time and money?

    Any advice anyone could give me would be very much appreciated!

    I Have Done A List Of My Charges,i Notice I Also Have Account Maintenance Charges Initially They Were £15 Then When Bos Merged They Jumped To £28 ,i Have About 40 Of These Charges Can I Claim Them Back?

    I wonder if someone could give me some advice. I'm at the stage where I'm about to issue a letter informing my ex-bank that I intend to start court proceedings.

    May I pose a few questions to the 'people' in the know?

    1. I've charges on my account that go back more than 6 years, I know the dates they were charged and the amounts applied, however I don't have the statements - can I make a claim for these charges or will they ask for proof in the form of a statement?

    2. My ex-bank has wrote back saying the charges were legitimate and said that if I was to go to court they’d prepare a defence, is this just a scaring tactic? They said that I would be in breach of contract and they would pursue damages to that effect?

    Can you give me any advice - should I issue my letter and proceed to court?

    Thank you in advance for your help in this matter.

    Firstly I don't think (although I'm not 100% sure) that you can claim beyond 6 years, I'm sure someone else will be able to tell you for definate.
    Secondly, your ex-bank is just using scare tactics, take no notice and carry on with your claim.

  • This might sound like a stupid question but HSBC have charged me an extortionate overdraft fee every month for the last 6 months - can I claim that back or is just excess overdraft fees you can claim for??
    V.confused on what I can claim for and what I cant!!

    Firstly, fabulous site, I am now writing to Bank of Scotland to claim back £6092 in charges and interest. I have a similar question to one posted earlier but mine may be different - My husband and I have mortgage with Bank of Scotland - currently a month in arrears. I'm happy for them to close my current account but could they use more forceful tactics on the mortgage account now that I'm a difficult account holder?

  • Hello all - new to the forum, but have already claimed back £400 from Natwest using this excellent site as guidance.

    I've started a new claim against Barclaycard now and received my 'Allocation Questionnaire' yesterday. All filled in and about to post it - but suddenly I'm a little worried about going to court - I would be hugely grateful for any advice from people who have come this far before.

    My claim is only for a couple of hundred this time. Still scared though!!:
