    Could someone confirm that when you send yoyr first letter claiming money back that you send it to your local branch. Thanks, Nettie

    hand one in at branch and send one recorded delivery ( cost you about a pound ) to head office/customer relations dept of bank:money:

  • Hi All, I just set the ball in motion for reclaiming my charges from the Halifax.

    I sent the 1st template letter out last Friday, 26th of May, together with a £10 cheque. Imagine my surprise when I got a reply this morning, Monday the 30th. They say they will send me the list of charges as requested 'shortly' and they also, shockingly, returned my tenner cheque!

    You can call me Mrs. Paranoid but such prompt answer and lack of greed in connection with a bank has frankly set the alarm bells ringing. I wonder if this is some sort of legal loophole they have discovered in order to delay sending the requested charges out to me. Since they have responded within the forty day period stipulated do they still have to comply with sending me the info within that time period? And similarly, does the fact that they have waivered the fee mean that they are not obliged to send me this anytime soon? Their use of the word 'shortly' isn't particularly comforting (how long is a piece of string?). I'd be grateful if anyone could help.

    This is what I am wondering about, as I posted about earlier today. A £10 cheque was mysteriously credited to my account on Friday. I know I didn't put it there and wasn't expecting anything so I'm wondering if they put the £10 postal order I sent them into my account. I don't know if they have done it in error or are timewasting or purely being nice to me lol!! :rotfl:

  • Do I have to answer the questions from Cobbets, the solicitors acting on behalf of NatWest, about 'contrary to the unfair terms in consumer contracts regulations 1999' Please specify all of the facts relied on by the claimant in support, and in paticular please identify the contractual provisions that the claimant alleges are invalid by reference to the regulations.

    As it's getting a bit confusing

    Sorry didn't see your post before writing mine. I reckon banks might've found that if they don't take the fee they're not obliged to respond within the forty days. Can't imagine any bank is just being generous :rolleyes: .

    Hope someone out there can let us both know more about such possible delaying tactics.

Got my statements through from RBOS on Saturday and even though I know we have been rubbish with money management in the past I was astounded that I have paid £4990 in bank charges over 6 years in 2 accounts!! I am prepared for a long haul as I am guessing they dont part with the 'big' cash easily ??? Spreadsheet all done and letter ready to go - wish me luck ......

    Amazing how it all adds up isn't it...I've only seen my last 2 years statements as I do online banking and they add up to £663 already and I've been quite good with money over the past couple of years :p so who knows what the previous 4 years will bring up!!

    Well I just rang the Halifax to ask who credited my account with a £10 cheque, he said it was paid in by my local branch and he didn't have details and he has asked for a copy of the cheque so that he can investigate which could take a week or two....seems like a delaying tactic to me...I told him that the cheque was made payable to Halifax PLC and not me so it shouldn't be able to paid into my account anyway?! :confused:

    I will still send off letter no. 2 next Wednesday if nothing happens :D

    Capital One are probably the most awkward outside of the big five Banks who operate credit cards. Their attitude is meant to be frightening by letting you
    know that their offer is final, we won't be increasing our offer and be a good person sign the settlement form (for the lower amount !) so we can save the
    courts valuable time. Red rag to a bull those comments from their Executive
    Office Manager - Robert Udy.

    I have had Judgement against them for one account because they maintained that they hadn't recieved the Court papers, with the second as they acknowledged service 24 hours after issue they have managed to secure
    a further 28 days in order to file a defence.

    GO FOR IT - don't hold back they deserve a good whacking.
