Well I just rang the Halifax to ask who credited my account with a £10 cheque, he said it was paid in by my local branch and he didn't have details and he has asked for a copy of the cheque so that he can investigate which could take a week or two....seems like a delaying tactic to me...I told him that the cheque was made payable to Halifax PLC and not me so it shouldn't be able to paid into my account anyway?!
I will still send off letter no. 2 next Wednesday if nothing happens
I think you're right there, all seems a bit fishy to me. I'm gonna wait to see if my list of charges come through the post in the next couple of weeks but I'm not holding my breath. I just don't know whether I should give them the full 40 working days until, if at all, I challenge them why they returned the cheque!

Having succesfully recieved 6 years of bank statements I have written twice to NatWest using the templates and recieved no response. So I have now used the moneyclaim website to take them to court. Very stupidly I didn't spot the template and wrote my own statement which was pretty much based on the text of the letters. I have looked into it and I can amend my claim but that would involve filling in an N244 form which would move it from moneyclaim to a county court. Does anyone have any idea about whether it is necessary to do this?

Do I have to answer the questions from Cobbets, the solicitors acting on behalf of NatWest, about 'contrary to the unfair terms in consumer contracts regulations 1999' Please specify all of the facts relied on by the claimant in support, and in paticular please identify the contractual provisions that the claimant alleges are invalid by reference to the regulations.
As it's getting a bit confusing

It is nice to see a settlement from the abbey in the success thread. I am claiming £4050 + interest from them and filed my mcol last week. I am finding this site a great support, particularly the success thread. I have one question though how will I know if the abbey acknowledge and/or defend? Will they e-mail me or does it show on the mcol site?0

No need to be paranoid about the return of the £10 fee, some banks simply dont charge for the service. HSBC is another and Co-op. Capital One credit cards dont either. They are still obliged to send the data within the 40 days.0 -
Can anyone tell me if you can also reclaim Commercial Charges back from the Banks ? My company is with Barclays and they charge an extortionate
£ 75 Management fee on top of the "Paid Referral" charges for breachiing your o/draft. As we are involved in a low-margin, high-volume industry, it happens quite alot to us; however these extremely high charges are increasing the difficulty levels tenfold. Can anyone guide me on this ?0 -

Before the threads merged I researched up to 98 pages of the Success Thread and found:
Abbey National - 19 cases of which:
11 settled in full plus costs and interest after claim filed at court
5 settled in full before any court action neccessary
2 claimants went to the Financial Ombudsman and the banks paid in full for one and more than the amount claimed for the other but no reason for this is given in the postmore than the amount claimed
1 case the claimant claimed £5,000 he had estimated as owing. The bank settled at £4,500. On receiving his details and checking he was only actually owed £1,000. There is no mention of them getting the overpayment back.
Hope that gives you a bit more of a boost.

hi,im wanting to claim my charges back from my capital one credit card(which is now closed),but i dnt hav my account details as got rid of them when i paid it off.does anybody know how i can retrieve them without letting cap 1 know what i want them for??0
