    this is only from statements covering the last 12 months, we are still waiting for the rest of the statements.

  • I am new at this but have been reading this thread since I started my cliam on the 21st Feb. I went through the steps as suggested and I am now at a stage whereby I am waiting for my local court to send me a hearing date having been through the MCOL and been transferred as HSBC have put in a defence.

    The thing that bothers me is in the whole of this time I have not received any offers from my bank and I wonder if anybody else has come this far and not received any offers/goodwill gestures.

    Their defence is that the default charges aren't actually penalties according to their solicitor but are instead charges for services?? Is this a normal defence?

    Please help.

    Claim amout: £2196 inc. interest and court fees
    Bank: HSBC

    I have just rang Natwest and asked if my statements can be forwarded, as I had not heard from them. She said that they could not send out the details as the address in Edinburgh where the original request went to as suggested on this site, is not linked. So she had no knowledge of me requesting this information. I therefore have to wait to hear from Edinburgh.

    Must admit I had similar paranoid thoughts when I rang NATWEST Customer Relations to check on the progress of a claim, before I could explain the purpose of my call they launched into a speil about sending me my last six years statements in a week and without charge!!!!!
    As I didn't have a complete set on my personal account and was sure there would be charges on the missing statements I had nothing to lose.
    Guess What ? I got the complete set in three batches (one duplicated) back within the week FREE OF CHARGE
    My advice if you are claiming against Natwest forget the forty days forget the ten pounds
    RING 0800 015 4212 Option 1 or 2 give them your account number and sort code, be ready to answer a few security questions
    Sit back and wait for a week your statements will arrive

    Hi

    My court papers were served to Halifax on 25th April they now have 14 days to acknowledge.
    Has anyone got this far with Halifax .. What will happen next please?

    Hi, all, I was wondering if anyone can help - as I clearly do not trust my bank! I sent the initial letter requesting my list of charges to the Halifax bank, I sent this 15th April, however they did not cash the cheque until the 18th April. I called them yesterday as in my mind it has gone past the 40 days in which they can reply. However they said due to demand etc they class the 40 days as the day in which they cash the cheque and that the 40 day period which is stated in my letter is 40 working days not calendar days - can anyone let me know if this correct and apologies if someone has already asked this question.

    What does section 3 and 4 mean????

    1 This defence is filed and served without prejudice to the right of the defendant to apply for summary judgement in respect of and/or to strike out the particulars of claim.

    2 if (which is denied) the claimant proves the allegation that the defendent debited charges to the claimants bank account, insofar as such charges were debited on a date or dates more than six years prior to the issue of this claim, any remedy in respect of the same, whether damages restitution or othewise, is barred by the opperation of the limitation act 1980 and/or the doctrine of laches and the defendent will applt to strike out this aspect of the claim and/or summary judement.

    3 The defendant is embarressed by the lack of particularity pleaded in the particulars of claim to the extent that the particulars of claim fail to disclose reasonable grounds for bringing a claim against the defendent. In particular the particulars of claim do not disclose any legaly recognisable claim against the defendent.

    4 The defendent invites the claimant to remedy the above. in the event that the claimant fails to do so within 14 days of the service of the defence then the defendant will applt to the court for an order striking out the particulars of the claim.

    I received this on April 25th, but as yet had nothing from courts...

    What do i do??????

    What if the bank does not charge a fee - but does not tell you or return your list of charges? Do you wait 40 days then go to letter 2?

    Also is the 40 days - working days or not??????

    Hi all, new to site, I live abroad but still have account with LTSB with overdraft (upto Limit). I would like to start claiming excess charges, but could they request that I pay overdraft off, which I am unable to do. Although have parachute account I would be unable to get overdraft facility from them as I said we live abroad and have no UK address or income there. Any help would be appreciated.

    It is 40 calendar days and it does not matter whether the bank charges or not - they are required by law to provide you with the info within 40 days.

    Has anyone had the same experience?

    My court papers were served to the Woolwich on the 11th April which meant that their 14 days were up yesterday. Logged onto MCOL this morning and requested the "Judgement by default" as they hadn't acknowledged the claim. Just double checked the status now to find that the Woolwich have acknowledged this today - is this correct that they can acknowledge after the 14 day deadline and after I have requested judgement? Very frustrated........
