    hi,im wanting to claim my charges back from my capital one credit card(which is now closed),but i dnt hav my account details as got rid of them when i paid it off.does anybody know how i can retrieve them without letting cap 1 know what i want them for??

    If you paid by your monthly payments for the card by direct debit your bank should have a reference/account number. Unfortunately once you submit a SAR they will probably immediately know that you are reclaiming charges as there are thousands of people already doing so. I wouldnt worry about that though and claim regardless. Good luck :)

    hi all,
    can anyone tell me if they know at what time i can enter judgment on MCOL after the 28 days are up?
    the 28th day fell on a Saturday, MCOL state they give an extra day if the deadline falls on a weekend or bank hol, well my 28th day was Sat 28th, i have tried to enter a judgment after 6pm,(today Mon 30th) but the web site will not allow me at this time, will they only allow you to enter this the next working day, if so at what time, can i do it a min. past midnight?

    I sent off all my letters to various banks, giving them the 40 days etc. However, I did not enclose payment as I know the amounts vary and some don't charge. So I put a paragraph at the bottom stating that should a charge be payable, please advise me by return so I can send it straight back. A couple of the banks have done this, RBS £5 and Natwest £5, Capital One - no charge. However, I want to know if I can still take the 40 days from the first letter. Do I have to wait for them to receive the fee? even if they have not responded with a charge for me to pay. Or do I have to wait till they reply and then the date I send them this information.

    PLEASE HELP - Hope I haven't made it longer on myself!!!!!!!!

    I have now filed for the court using mcol, do i need to send a letter to the bank to say i have done this, or do the courts do it for me, also, do i need to put acc numbers on the particulars on mcol??

    No you don't need to contact your bank as MCOL will do all the necessary for you but do put your account no: on your particulars (well i did!!)

    It's 40 days from when they receive the request AND payment.

    Hi shoe, you're welcome. As advised in pm the court will send you a copy of the banks defence. I havent come across anything on monument sorry but, like the rest of banks and credit cards, they arent exempt from paying back your charges and its just a matter of time ;)

    I've seen quite a few posts of people waiting up til midnight to hit the button so that does seem to be the way to play it yes. Good luck :)


  • Sorry didn't see your post before writing mine. I reckon banks might've found that if they don't take the fee they're not obliged to respond within the forty days. Can't imagine any bank is just being generous :rolleyes: .

    Hope someone out there can let us both know more about such possible delaying tactics.

    Must admit I had similar paranoid thoughts when I rang NATWEST Customer Relations to check on the progress of a claim, before I could explain the purpose of my call they launched into a speil about sending me my last six years statements in a week and without charge!!!!!
    As I didn't have a complete set on my personal account and was sure there would be charges on the missing statements I had nothing to lose.
    Guess What ? I got the complete set in three batches (one duplicated) back within the week FREE OF CHARGE
    My advice if you are claiming against Natwest forget the forty days forget the ten pounds
    RING 0800 015 4212 Option 1 or 2 give them your account number and sort code, be ready to answer a few security questions
    Sit back and wait for a week your statements will arrive

    Thanks for that, but since all banks are different I guess I'll just have to wait and see. I was particularly surprised that Halifax didn't charge for this since they have no qualms about making a massive £39.00 charge for overlimit etc, which I reckon must be one of the highest charges.

    Anyway fingers crossed :cool:
