    Please help!!

Natwest solicitors have filed a defence, they have told me i have 14 days to respond.
They say they have sent same letter i received, to the courts.

My question is.....Where do i get an allocation questionare??
Should i hear from the courts???

I received the defence on Friday, but nothing from the courts.

Some judges are setting aside the requirement for the Allocation Questionnaire as they are getting annoyed at the banks not turning up and using this as a delay tactic. Best to ring the court to find out if you will be receiving one. Good luck with your claim :)
  • Hi, this is my 1st thread, I have used the template letter on the site, which I sent to Lloyds TSB on weds, I'm now just wondering if I had to put the sort code in ? On the template it only told me to input the account number, will they still find my account without the sort code ?

    Thanks

I've started a claim for approximately £950 against Abbey. After 10 days I've received a letter from them stating that they will investigate and get back to me in four weeks!

What should I do? Sit tight and wait or chase them up?

If you intend to use the Financial Ombudsman to pursue your claim the banks are allowed 8 weeks to reply under rules set out by the FSA. You may receive another letter in four weeks from the Abbey to say it will take another 4 weeks to fully investigate your complaint.

If you want to follow the court process the templates and timescales therein on this site are laid out to allow the bank ample time to resolve your claim before you take it to court and this is all you need to allow in that case.

You can follow either process and timescale and good luck :)

Yes but they might just be awkward and ask for it anyway. Either way dont worry about it :)

    Hi All,
i'm with Natwest, has anybody ever recieved a letter from them telling them they won't be sending anymore letters out telling you when they are going to charge you for not paying a "DD", & just apply the charge to the account.
I'm sure i had a letter from them telling me this, as the last time a DD didn't get paid, it wasn't untill the company claiming the DD informed me that it had been refused that i knew anything about it & i have not had any letters from the bank.
This being the case, they are ripping us off even more as they havn't even got the cost of the paper & stamp to fork out for.

    Cheers,
    L

hi, i havn't received letters from natwest for a couple of years, i lodged a complaint but never heard anything, when i went into the bank they said they do not have to send letters out for every charge, so i asked what i was getting charged for and would they charge me more for a letter he he . of course there was no reply
    :rotfl:

    Hi there,

I had an account with the Halifax whilst at uni, and after I finished I stopped using the account. However I forgot to cancel a couple of standing orders that went out, and as there was no money in the account I was charged the standard unpaid fees. This led to a few 'overdrawn' fees, all in all came to a couple of hundred pounds.

As I had moved address, I didn't receive any of the letters the bank sent out and knew nothing of the charges until I applied for credit last year and was declined due to a default the bank had registered on my student account!!

Anyway to the point, my question is, if I claim back the charges from my old account, will the Halifax be obliged to remove the default from my records completely?

    -/

Sorry for the long post and thanks in advance for any responces

    Welshlad

    i found this for you!!!

Finally, if you have been defaulted for a debt which has been caused by unlawful charges, you must make it clear to the bank that any settlement must include FULL REMOVAL of the default entry - not merely a correction or amendment. However, to achieve this, you will have to include a claim for the removal of the default. Please see on the forum for discussions about this as it is a complicated issue.

i didnt put sort code on letters as you put your branches address on letter so in theory there is no need to put sort code on as you local branch's address is on letter and the sort code is branch's id number
