Hi i was woth barclays bank for some time in the past, they got rid of my account over six years ago, purley because i was rubbish at money management and was constantly being charged! I still have my statements somewhere, is there any way at all that i can get these charges back??
If so ill be laughing, seriously- it was that bad!!!!!!

I phoned Coventry BS this afternoon and told them that I’d received a letter from them telling me that insufficient funds were in my account and that a charge of £20 was made due to being overdrawn. I then proceeded to ask if this could be refunded. The guy on the other end of the line first of all checked my account then put me on hold, a little later he came back and explained to me that he’d had a word with his manager and said that they would refund it seems it was the first time I had done this, he then told me to try and not let this happen again.

I didn’t need to say much really I just explained I’d received a letter from them and asked if it were possible if they could refund the charge, that was all really. I don’t think that I will let this happen again if I can help it and not with them anyway as I will be switching to A&L pretty soon. I better keep my eye on the ball next time.
Martin you’re absolutely right if you get a bank charge for the first time, rather than trying this fight, just call up, apologise, tell the bank you’ve got a good record and politely ask for a refund. Often it will give it.

Yes you can reclaim them but you do need proof of what you are claiming for so the statements are essential. Follow the process as laid out in the main article with the template letters and timescales as usual. To claim back further than 6 years you need to use the Statute Of Limitations Act in your favour.
Section 5 of the Statue Of Limitations Act states that the action (claim) must be brought within 6 years of the cause of action (charge). This is what they would rely on in court.
You can defend this statement using this section of the same act (c) which states:
Section 32
(1) .... where in the case of any action for which a period of limitation is prescribed by this Act, either-
(a) the action is based upon the fraud of the defendant; or
(b) any fact relevant to the plaintiff's right of action has been deliberately concealed from him by the defendant; or
(c) the action is for relief from the consequences of a mistake;
the period of limitation shall not begin to run until the plaintiff has discovered the fraud, concealment or mistake (as the case may be) or could with reasonable diligence have discovered it.
Its a bit strong to accuse the bank of fraud and probably better to imply they made a 'mistake'. Good luck

I dont know about your mortgage fees sorry perhaps someone else can advise on that.
To claim back further than six years you can use the same template letters as usual. The bank will state that the Statute Of Limitations Act applies and that cannot do it. You reply basically with what I have posted above to state that you can.

Hi, I'd really appreciate any advice on my situation.
I bank with HSBC and have £700 overdraft limit. Got paid monthly wages, then didn't realise I had gone over my overdraft (I'm now -£900). So, got charged £150.
But HSBC charged me while I was still overdrawn, so gone further over my OD.
Now, got paid again this month but my wages wasn't enough (because of charge). Now, had phonecalls from HSBC to say I'm being charged ANOTHER £150 this month. Told them not to take it coz it'll send me OVER my overdraft even more. They will not listen.
It's like a vicious cycle, I'm overdrawn because they charged me, so they charge me AGAIN the next month, so I go even more overdrawn.
I can see this happening for a few months. But had letter demanding full payment, or face closure of account.
I'm really scared about this. They're guna keep charging me and I dont have enough money to pay the charges. I can't borrow from anyone. I've applied for second jobs n bars etc to try pay the charges.
My situation at present; aged 21, work full-time but going to Uni in Sept. Live with parents, only outgoings are car payments (£167), insurance (40), rent to parents (100), phone bill (40) and odd things. Have cut down A LOT!
What can I do? PLEASE help.xx0 -

i would like some advice on a situation please
i have finally plucked up the courage to reclaim my unfair bank charges,got the total charges off the intrenet etc,and was going to send off theletter demanig my money back etc
but....a couple of weeks ago my bank lloyds charged my £60 and i just wrote telling them it was unfair etc,now they have written back saying that they wud refund my the £60 .so i am just wondereing if i have blown my chances of asking back for my 6 years worth and if not what is my next step.should i just contine or what should i do?

Lloyds have put in a defence to my claim stating that they wish to defend all of my claim for £1220 inc int and court charge. That was a week ago, any ideas on what will happen next? Do i just have to wait for a court date?

They've only refunded one unlawful charge when you're perfectly entitled to claim for 6 years' worth, so go for it! Get your statements, prepare your spreadsheet showing each charge (apart from the one you had refunded), the reason for it and the date and send it to them with Martin's template letter.
