i just did this today. i hadn't even recieved an offer, but i had no reply from them (the bank that gives you extra ha ha) so i submitted my claim online today. i haven't told them. the court wil notify them......templemoose wrote: »Ho hum, it seems that Barclays do not negotiate their 'goodwill' offers so i am going to begin proceedings.
Could anyone tell me if i'm right in thinking that as soon as the 14 days(lba) is up i can file the claim regardless of whether they have made me an offer? I do not need to contact them again first? Just that this would give them more chance to get a defence together in time!halifax: settled paid £2622.18:j

I am currently in the middle of claiming bank charges (£2,000) from Halifax. They have until next Tuesday until I commence with court action. They got back to me yesterday to confirm that they will offer no more than they have (£440)... do i have to wait until next Tuesday or can I get on with court action now. I started the whole proccess back in the sunny days of August and now the winter is
drawing in...
To all those Halifax Account Holders who have had problems getting Charges back from the Halifax.
I started the process in June 2006 and used the "Which"template letters at the time as I didn't know about moneysavingsexpert.
The Halifax sent me a three page letter with a list of the charges from 200 - 2006. This totalled £1,600. I wrote back using my first template letter. They replied offering £233. I refused and used the 2nd letter and then rang the Chairmans office telling them I would take Court Action if I didn't receive a fair offer. They then offered £700. I refused and put someone else on the phone, they made an offer of £1,000 which I accepted as I was broke and needed the money there and then. They paid it into my account a week later.
It's worth ringing up the Directors Office of the Halifax. The number is: 01422-332598 and ask for: Eileen or Rebecca Scott, Jules or Sue. If you have the name of the person you can negotiate with them on the phone and then follow the conversation up with a letter.
Although I didn't have all £1,600 I got back £1,000 and have since then pursued them for other charges which have been slapped on my account.
They have since then refunded £39 4 times since I rang the Directors Office.
The Halifax very rarely give all the money back, but once you start the communication with them, they will not forget you!
Hope this is helpful

thank you for this advise. do you think that if i phoned and said that i'd just submitted a claim today and have paid the costs for the court already that they'd be open to negotiation? how did you start the conversation off?To all those Halifax Account Holders who have had problems getting Charges back from the Halifax.

I will give that a try that if they give me the usual bull. They owe me £2445.00 which I want all of. I am prepared to go all the way to court if need be.
I have sent me first letter off requesting a refund lets see what they say.
Halifax request for refund sent 30/3 (not received)
Barclaycard requested list of charges sent 30/3 (received 2/4)
Natwest requested list of charges sent 30/3 (received 2/4)
Halifax CC requested list of charges sent 30/3 (received 2/4)
Barclaycard requested list of charges sent 4/4My Mission today is to have an opinion on everything.
If you don't like it well you will just have to lump it!0 -

Following on from my 6/3 success receiving charges from HBOS
My warning is this:
If you owe the bank any other money, i.e. credit card or any other account that is overdue they will be waiting to take this money from your account as soon as your reclaimed charges are credited.
My account was credited with £1762 one day and debited with £907 (the amount owed on my HBOS visa) the very next day under 'cash'. They say they are entitled to do so under the t&c of your account.
I reasoned with them and told them they could keep £107 but i needed the rest to pay bills and they agreed to refund my account. But they very nearly put me into an overdrawn position again. ( i didn't let them keep the whole amount because £560 of the £907 is charges which i am in the process of reclaiming.

Hi there, it's your £28 so claim it back, no need to request statements as you know what charge you have. Just send your letter requesting them to repay it & send to your local branch (use the 1st template letter if you want). My friend did it with Abbey, wrote "her own" letter & she was refunded just 2 charges. Good luck
