Hey - tried reclaiming charges from Nationwide and they have refused based on their terms and conditions and also claiming they are within their rights to charge the amounts, even after threatening court action, which I now intend to do. Its annoying as they only provided two years data and it took 8 weeks to get it, and the amount is only £450!
Has anyone else tried claiming charges from Nationwide and if so how did it go?0 -
hi i am claiming bank charges from halifax i have issued with MCOL they have acknowledged it on the 2/4/07 they have made an offer which is not acceptable but can you tell me if when the 28 days are up wot happens how long do you have to wait for a hearing date or is the hearing date on the 28th day0

Hi all ok i sent my first letter asking abbey for my statements on 26-2-07 had the normal letter back saying they got my check that was cashed on the 13th march. Ive had my 14 months of letters but when would there 40 days be up is it from when i posted the letter 26th or would it be the day they recived it 27th or from when they cashed the check 13th if its from the 27th then the 40 days is up on satarday and what would i need to do then.0

I just had a thought.
A few years ago my worst half had a few problems with a car loan. She was charged about £40 for a letter and about the same for missing a payment.
This happened on a few occasions as we were struggling at the time.
The question.....could we claim those excessive charges back??
Any help would be appreciated.

I wrote to co-op asking for 6 years details of a closed account giving the usual details for tracing purposes. I experienced a bit of to-ing and fro-ing with the staff member dealing with it 'being out of the office' twice but didnt mind so much since they had plenty of time in the 40 days to complete the task. Today after a reminder email that they have 12 days to complete the task I have received reply that they are unable to trace through archived records without an account number.
I smell the proverbial bull but I am stumped as how to counter this. Any advice please ?
I too would have thought that they could trace an old account through name and address etc.....I also thought a business had to keep detailed records and accounts for a 7 year period for auditing purposes. I wish I knew the answer!0 -

Its the same principal as bank and credit card charges so got to be worth a try.0 -

Basically, yes they can say that. However, they arent your only options. You cannot be forced to sign an agreement for a loan. They are trying it on basically to get you take out a higher interest rate loan than the overdraft rate you're paying now. It does not benefit you at all and you are perfectly entitled to refuse the offer. You cannot be forced to pay it back in full. They can ask but they cannot expect it.
You can offer to continue to pay £50 per month until the overdraft is cleared or your charges are refunded. They *should* accept.
If they dont accept, there is no other reason not to accept than that you are reclaiming bank charges and that would be retaliatory. I would certainly complain to the Financial Ombudmsan regarding this as the arrangement had been perfectly satisfactory beforehand. Regardless, they cannot make you pay more than you can afford and any payment arrangement would have to be based on your income and outgoings as before.

I Sent A Letter Recorded Delivery With £10 For 6 Years Back Dated Bank Charges 8 Weeks Ago Recieved Letter Today 3 April 2007 With £10 Returned And Only Statements For First 2 Years They Say In There Letter To Send £10 With Passport Photo And Signiture To Recieve The Six Years Charges And To Wait Another 40 Days Can Anyone Please Help Thanks Very Much.
I call shenanigans, beats me why they want a passport photograph.. how do they know what you look like anyway ? :rotfl:
Seriously, if this was a security requirement when you took the card and you had to supply one then then this is the only valid reason I can think of to send such a thing. If not then I would seriously question it.
Query the photograph for sure but send the signature and maybe something with your name and address on like a utility bill as proof of ID.
Do not send another £10 or wait another 40 days. Point out to them that you have already paid the statutory fee of £10 for your Subject Access Request under the Data Protection Act and they have failed to complete the task. Therefore you are not liable to any charge and are entitled to receive the rest of your data in the time left of 40 days since first sending your letter. However long that is is however long they have left to give you the rest of the details.
