Hi!
Im filling out my money claim on line at the mo. When you get to the last page and it asks if u reserve the right to claim interest, Im a bit stuck.
Ive already been including the interest in the amount they own, so if i tick this option will it add more interest? Or do I NEED to tick because Ive already included it?
Sorry, Im really not sure!!
Thanks0 -
Hi, I am in the process of trying to reclaim my daughters bank charges, about £900 in all. I have got to the second letter from the Lloyds TSB, the first was telling me that they were looking into it.
The second however has left me a bit puzzled as to what to do next. They say.
The Office of Fair Trading has published new guidlines on credit card default charges. We're still talking it through with them, but the important point is that the guidlines are about "default" charges that people pay when they break an agreement with us. This doesn't apply to your charges as these were for dealing with your request to go over your agreed overdraft limit. They are not default charges because you haven't broken your agreement. They are our prices for the service we provide in these situations.
Some of these charges were for over £100 for an unpaid direct debit.
Any advice would be very much appreciated
Thanks.0 -

They have taken to calling these charges 'service' charges as an attempt to get out of paying them. Please see post #4986 in this thread above for charges you can and cant claim for. You can reclaim unpaid direct debit charges and it will be up to the bank to prove in court that their 'service' charges arent excessive. I would carry on, good luck0 -
I have sent off 2 letters about reclaiming my bank charges roughly £1000 I received a letter the first time they said the charges are lawful, they gave me a certain amount of time to reply to this and i have done I have heard nothing since, i ave called them and they keep giving me a number to call which is constantly engaged. what should i do. i was considering the small claims court but there is a £120 charge for this, and if i dont win i have to pay, is this right. can someone please give me advice, im getting a bit stuck on this!

Have you checked if you are eligible for exemption from the court fee? Information here about this:
http://www.hmcourts-service.gov.uk/infoabout/fees/exemption/exemption.htm
If you do have to pay you have the option of raising the issue of unlawful charges with the Financial Ombudsman which is a free service. Information how to complain here:

Overall and without being specific the banks tend to follow the same route. They use the process to delay as much as possible then end up paying out in some form of settlement before court. If you are worried about court this post may help, it is particular to Barclays and top thanks to OP showmethemoney! for her post.

you bet your life its worth it, it is after all your money, you could allways try your luck with a phone call to your branch and if they say no tell them you intend going through the whole claiming it back procedure, you might be surprised. let us know how you get on0 -
I have been trying to reclaim bank charges from Lloyds TSB since August 2006 and have had all the usual responses today i got a 'Notice of Transfer of Proceedings' which was scary in itself it also asks me to return the allocation questionnare but as i dont know what that is i dont know what to do. Have come too far now to throw in the towel!0

I'm about to file another MCOL claim this time against Lloyds (only for £35!) but I've realised last time I didnt have to pay the court fee because of how much I earn but do I have to actually go to the court to hand the form in or send it to them before I start the proceedings?0
