hi quick question !! sent a letter to halifax to ask for my bank charges back gave them the 14 day limit. today i received a letter stating that they were sorry im unhappy with the bank charges and the financial services authority gives them 8 weeks to investigate and respond!!!! if they cannot respond fully with in 4 weeks they will write to me and update me !!! aaarrrgghhh !!!
can they do this ?????
what should i do next ????

They have entered you into their complaints procedure and this is their timescale for this. You dont have to follow it and can carry on with the process regardless so send your next letter accordingly. Good luck0 -
Basically, yes they can say that. However, they arent your only options. You cannot be forced to sign an agreement for a loan. They are trying it on basically to get you take out a higher interest rate loan than the overdraft rate you're paying now. It does not benefit you at all and you are perfectly entitled to refuse the offer. You cannot be forced to pay it back in full. They can ask but they cannot expect it.
You can offer to continue to pay £50 per month until the overdraft is cleared or your charges are refunded. They *should* accept.
If they dont accept, there is no other reason not to accept than that you are reclaiming bank charges and that would be retaliatory. I would certainly complain to the Financial Ombudmsan regarding this as the arrangement had been perfectly satisfactory beforehand. Regardless, they cannot make you pay more than you can afford and any payment arrangement would have to be based on your income and outgoings as before.

Not sure what to suggest about co-op. They really should be able to trace from your name and address. They are probably just trying to fob you off. Keep persisting, eventually someone may answer the phone who will help.0 -
ive recently taken the first step in reclaiming my bank charges which is a few pages long......... i was wondering if someone can clear up which charges i can actually claim back. On the the statment of charges i had fail dd unpaid standing orders over draft intrest, overdraft excess fees and account charge just for having the account which of these charges am i actually entitiled to claim back. I thought it was all as the letter asks the bank to send back a list of charges but my partner thinks its just failed DD and standing orders. Any help would be very much appreciated????????

You have been provided with all personal details relating to the account and according to information directly received from the Information Commissioner today an account number is not neccessarily required for a Subject Access Request under the Data Protection Act 1998. Further, archives held on microfiche are a relevant filing system for the purposes of the act and it is your responsibility to present this information in intelligible format.
Failure to provide the information requested is a breach of my entitlement under the act and subject to complaint to the Information Commissioner. You now have 12 days in which to complete this task and I await receipt of my information.

I've posted this in case the information helps someone else. I'll post whatever reply I get if/when I get it. They claim so often not to be able to supply details without an account number and I would like to think they can be caught out. Here's hoping anyway and its worth a try at least to bluff them out of it.0 -
Just had blue murder with Barclaycard
my dad called trying to find out his account number but as it had been passed to a DCA the guy on the other end of the phone refused to give it to him so I got on the phone and asked for it he told me he had the account number but was not prepared to give it to me so I asked for it to sent through the post he refused and started to talk over me so I told him I was going to put a complaint in to the FO he carried on talking over me and put the phone down HOW IGNORANT
I called Barclaycard back straight away (Oh dear if there is one thing I don't like that is people talking over me and putting the phone down ) I asked for a number for complaints dept he tranffered me back to the collections where I started and he was a very understanding man after I told him that under the data protection my dad was entitled to his account number and that they did have the information as by law they had to hold this for 7 years and if it wasn't supplied I would tomorrow be talking to the FO. I made an official complaint about the Ignorant idiot in the collections dept and got lots of appologies and the account number straight away.
so you can get the information that they hold if you just treat them as the bunch of cluckers they really are:AMy Mission today is to have an opinion on everything.

Is it worth my while reclaiming the £28 I was charged last month for going £2 overdrawn? I don't have any other charges to reclaim.

I wrote to co-op asking for 6 years details of a closed account giving the usual details for tracing purposes. I experienced a bit of to-ing and fro-ing with the staff member dealing with it 'being out of the office' twice but didnt mind so much since they had plenty of time in the 40 days to complete the task. Today after a reminder email that they have 12 days to complete the task I have received reply that they are unable to trace through archived records without an account number.
I smell the proverbial bull but I am stumped as how to counter this. Any advice please ?
Hi Twinkly after reading your post it sent me on a task to see if it could be done and I have sucessfully retrieved my dads barclaycard account number after a bit of a to do even though it is closed and with a DCA.
it can be done ring them and stand your ground.My Mission today is to have an opinion on everything.

Yes I am pretty damn sure it can be done I just need to sound as though I KNOW it can be done. Keeping it all in writing, as is my practice anyway after having a stroke a few years back my memory isnt so great. The ICO did advise on the phone to send them all copies of correspondence so they can investigate a breach so its proved good practice in this case0 -

In this case it might be worth a simple letter explaining it was a one-off and your account is normally run very well. That since it was such a small amount overdrawn you would appreciate the refund as a goodwill gesture. If they say no you can go the reclaiming route but its worth a try. Good luck0
