Hiya, quite new to this so sorry if i,ve posted to wrong place. I could really do with some advice if anyone can help?

I have a lloyds bank overdraft of £350. My balance is currently at £711.
I have an arrangement to pay £50 per month to reduce balance.

This was before I knew about claiming back charges. I'm currently trying to claim back £1125 which would pay off the overdraft with some left.

I'm was on the second letter to lloyds and have received what seems to be a standard letter saying they will pay nothing. I'm going to file an online claim but can't afford the £120 court costs probably until the end of May.

Do I keep paying the £50 per month whilst this is sorted? They have written separately to say my arrangement with them is up now so I need to telephone to make another or pay overdraft in full.

On the one hand I'm claiming enough to cover the overdraft. On the other if I dont carry on paying could they take me to court before I can afford to take them?

Hi, Lloyds have now written to me offering to put the whole overdraft onto a loan. Does anyone know if this is a good plan? Not sure whether they are trying to help or being sneaky and up to something! Would be really grateful for any advice.

My advice is a flat out NO.

Do Not put this onto a loan of any sort. You have already stated that the reclamation of charges will more than cover the remaining overdraft and leave you with money over. There is no sense whatsoever to agree to a loan to cover these charges in the meantime. Carry on paying the £50 per month - think of it as a savings plan. The more you pay in the agreement already in place the more you will eventually have left over after reclaiming.

    :)

Thanks for the help, please see below-
'I am claiming for all bank charges taken from me over the last 6 years, I have sent 2 letters requesting them back. 1 Letter on 2nd March for £1144.06 and 1 letter on 19th March for £1147.31 which includes added interest upto 16.03.07 but have not recieved any settlement yet. I am requesting £1147.31 in total. This is £891 in charges and £256.31 in interest upto 16.03.07.

The claimant claims interest under section 69 of the county courts act 1984 at the rate of 8% a year from 31.08.02 to 16.03.07 of £256.31 and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of 0.016%.

thanks in advance for any advise you have.

    Lindsey

Please can anyone help me and advise if above info is enough that I have put in my court claim.
    Thanks

I have used all the standard form letters offered on this fabulous site and now have received a second response from Barclays, offering to settle my claim of £4,660 for a "good faith" offer of £1,980. They claim all charges are standard, and published, and they are sorry I am unhappy with the historic charges. I can get a refund applied to the account within 7 days if I settle. They also give me the phone number for the complaints manager.

This offer has come in 10 days after my second letter asking for a response within 14 days.

I am clearly inclined not to settle, as the offer is less than 50%, and to take them to court. Any suggestions?

Only other possibility I suppose is to try their complaints manager phone number and see if that has an effect....

You can claim all charges except the interest and I do not think you can claim the account charge as some accounts you have to pay for if they offer you added benefits, check out the reclaim help thread for a comprehensive list...

My suggestion is to write and accept the payment in partial settlement without prejudice and advise you will continue to court to reclaim the remainder of the original amount. I'd advise to get any terms of acceptance of this amount in writing with a clear date for payment. Telephone calls are too easy to deny as having taken place and you need proof of what you are accepting and to read carfeully any terms and conditions before doing so. Dont get caught out and good luck :)
