    A bit of background:

    i'm claiming from LLoydsTSB current account and Clydesdale closed business account. Have sent them bothe the original letter asking for refund and received a standard reply from both. then sent second letter giving 14 days to reply. Haven't heard from clydesdale yet but this morning received a letter from lloyds refusing any refund. Interestingly they did not refer me to their terms and conditions as per previous letter but stated that I had been charged for a service they provide!!! They say that they are aware opf the recommendations from the OFT re Credit Cards but as I have not defaulted on my account they do not apply to me. :confused:

    i do not want to pursue either of these claims in court because both amounts are over the £1500 threshold we have in Scotland and I would need to use a lawyer so I have contacted the financial ombudsman who are sending me out their claim forms. the question I have is, if the FO state that the bank must resolve this matter within 8 weeks from the complaint is that 8 weeks from the date I first complained to the banks? Also I have not calculated interest. Is it too late to do that now?

    The bank would enter a defence saying lack of particulars/embarssed etc so you'd know if it was heading for a strike out.

    Amendment is on form N244 and costs £35 non refundable.

    'I am claiming for all bank charges taken from me over the last 6 years, I have sent 2 letters requesting them back. 1 Letter on 2nd March for £1144.06 and 1 letter on 19th March for £1147.31 which includes added interest upto 16.03.07 but have not recieved any settlement yet. I am requesting £1147.31 in total. This is £891 in charges and £256.31 in interest upto 16.03.07.

    The claimant claims interest under section 69 of the county courts act 1984 at the rate of 8% a year from 31.08.02 to 16.03.07 of £256.31 and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of 0.016%.

    Got as far as a court date and the day before the papers had to be at the court they wrote with a settlement figure. Slightly wrong so asked then to revise it and they did.

    Going after the charges they put on my acc since claim started now!

    Careful with another claim on the same account - in your settlement letter they may have suggested your account will be closed if you dispute further charges...

  • Hello. I am in the process of reclaiming bank charges from Lloyds. I am a nearing the stage of taking legal action to recover £930. As the Scottish small claims courts only deals in claims up to £750 I would be grateful for any advice on this matter.

    For claims between £750 and £1500 you need to use a Summary Cause. Info should be on the Scottish Courts Website of search this board for reclaiming in Scotland.

    not 100% sure but would give it a try - you can on credit card late payments so cant see why not

    I am in the same boat as you only with a halifax credit card and barclaycard both with DCA they have still added on the charges I don't think just because you are having a hard time and the banks and credit cards help you run the debts up with charges that the court would rule against you. Go and claim everythink that you can from them and don't stop until you have got everything that you are owed.
    it is about time the banks got taught a lesson with their charges.

    halifax requested refund 30/03/07 ( no letter received as yet)
    barclaycard requesting charges list 30/03/07 (they received letter 02/04)
    halifax CC requesting charges list 30/03/07 (they received letter 02/04)
    Natwest requesting charges list 30/03/07 (they received letter 02/04)
    My Mission today is to have an opinion on everything.
    If you don't like it well you will just have to lump it!

    i was just wondering if anyone would be able to help me here... i'm looking for the address' that i should be posting the inital letter to the banks i'm with
    The first being Nationwide
    the second HSBC!
    i thought i had the right address' but my sister is saying that it's another address i need for both of them
    i had the head office address for one but she has told me something about the data protection part of the bank that i need and it's got me all confused!
    if you can give any help it will be greatly appreciated !

    Just write to your banks main address, ie if you live in bedford and that was where you opened account, write to them, once they start acknowledging letters then they will give you the new addresses to use
