    This is going to sound like a really dumb question but at the bottom of the MCOL form it has a space for a signature - I know I can't sign it but do I need to type anything in there at all or do I need to just submit

    List of charges

    In order to defend the claim in the court after submitting it, do we need to have a list of the charges prepared to return if requested. I have only written a rough list but will prepare one if advised here. (I don't think my pencilled copy would suffice)

    You will need a comprehensive list of the charges and interest if you end up at court as your evidence of claim. The calculator on the main article here:

    might be the easiest way to do this if you have a printer and can print it off.

    You'll find most of the answers to questions in the Reclaim Help Thread, which is linked in my signature.

    However you can't use the RBS HO address on MCOL as its in Scotland, so use your own branch address if its in England/Wales.

    I have sent the first letter to Lloyds to reclaim £450 in charges.
    I have received a reply saying that the OFT is dealing with "default charges". It further states that these dont apply to me as the charges involved were for "dealing with your request to go over your agreed overdraft limit" and therefore are not "default charges". However the charges are labelled "Overdraft Excess Fee" and "Unpaid Direct Debit".
    These seem to be penalties to me. Does anyone have any opinions/information on this?
    Is it just lloyds trying it on?
    I'm planning to go to the Small Claims Court about this.

    The OFT is dealing with the issue of banks charges and their report has been put back. See here for more information:

    They can wait for the outcome but you dont have to.

    They are trying it on, they are penalties and you can reclaim them. Good luck :)

    I recieved my statements on Friday morning after 44 days so I have now sent off my second letter the total amount of charges from the Hbos is £1071 so i will keep you's posted on what happens now thanks everyone JH

    Hi guys - sorry, have been going round in circles on this site. So much to take in. Can anyone direct me to the correct addresses for claiming back credit card charges - have already got the statements back after applying to edinburgh, now wanting to send letter 2 but where do I send it.
    Also now sending pre-court letter to Nat West for current account bank charges. Where do I send this, as all my previous correspondence went to the local branch which I might add they haven't even had the courtesey to reply to me. Any help would be appreciated.

  • I have got to the court stage with Lloyds TSB who owe me £2500 in unfair charges. They have filed a defence so am now just waiting for a court date. however I have just checked my account and they have paid in £750 as a goodwill payment. I have received no information about this so haven't signed anything, but my worry is that if it goes to court they might turn around and say that I accepted this payment and am therefore not eligible for any more. Has anyone else had this with Lloyds, and can you advise on the best course of action?
