Hi everyone, sincere apologies if this has been covered already but I'm just waiting on statements from Smile to claim back charges from my own current account but I'm also a joint name on my husbands account - obviously they can close my account if they choose to but does anyone know if they can also close the joint account where hubby's the primary name, if they want to??

Its my understanding that Martin MSE says to get a parachute bank account in case they do close your bank. But the 'ombudsman' says that banks are not allowed to close your bank account. (saw it on watchdog). They might but you are in your rights to take it higher to the ombudsman if they did. I think it would be unlikely that they'd close your hubby's bank as it's a seperate account altogether and that would just be deliberately criminal/spiteful!
Don't panic, but if you are worried open an account elsewhere maybe as martin suggests.

Deadline up today for their response to my first letter so I have just drafted letter two, with a breakdown of charges and interest ready to go by recorded delivery. I have dated it tomorrow and will post it tomorrow to give them an extra day. (I am so kind), then we'll see what happens.
It still appears that Nationwide are letting it get to court before buckling unless any one knows different?

Hiya, quite new to this so sorry if i,ve posted to wrong place. I could really do with some advice if anyone can help?
I have a lloyds bank overdraft of £350. My balance is currently at £711.
I have an arrangement to pay £50 per month to reduce balance.
This was before I knew about claiming back charges. I'm currently trying to claim back £1125 which would pay off the overdraft with some left.
I'm was on the second letter to lloyds and have received what seems to be a standard letter saying they will pay nothing. I'm going to file an online claim but can't afford the £120 court costs probably until the end of May.
Do I keep paying the £50 per month whilst this is sorted? They have written separately to say my arrangement with them is up now so I need to telephone to make another or pay overdraft in full.
On the one hand I'm claiming enough to cover the overdraft. On the other if I dont carry on paying could they take me to court before I can afford to take them?0 -

I'd keep up with paying the regular payments on the overdraft as your claim could go on for some time yet. If you file with moneyclaim, they get 28 days to lodge a defence etc, then you have to wait for a hearing date.

Re the £750 limit to court claims in scotland
Does anyone know if this is just for the charges claimed or includes interest and court costs.
I ask coz my charges are just under £750 but obviously interest and costs would take the figure above the £750 limit0 -

Hi again
If you have online banking with HSBC, log into your account, then at the top left hand of the page, you will see the 'My Accounts' section - in there is the 'My Statements'. Click on this & your last 6 years statements are there for viewing.
Make a seperate list on your PC of all your charges & the date charged(including the exact wording for the charges) & then go to the 'Interest Calculator' (in the 'Reclaim Bank Charges' doc on this site's main page) to calculate the interest for them, thus getting your full amount to claim!
