    Its quite plainly a stalling tactic. Why they expect you to believe that their departments deliberately do not talk to each other is beyond me. It insults peoples intelligence.

    If the court want it they will request it and it is part of your claim so you would be taking it into court anyway.

    Simply, all you need to do is send them the details of the charges and interest again. Theyre being awkward thats all. Good luck :)

    I have received notification from MCOL that HSBC have acknowledged my claim and intend to defend!!:mad:

    I am a bit worried now as the defendants have solicitors and I dont!:sad:

    Can anyone tell me if they have got past this point with HSBC & what has been the outcome?:confused:

    I really am concerned and just need to know there is light at the end of the tunnell!!:eek:

    I researched HSBC in the success thread on this site up to about page 98 I think. Of 115 cases only 4 state they went as far as court. I only found one of these 4 where HSBC had employed DG Solicitors but they made offer of claim in full & interest & costs so try not to worry too much. Hope that helps and good luck :)
  • We have 2 current accounts with First Direct and credit card account, which we plan to reclaim charges from.

    My question is:

    As these are three separate accounts, should they be dealt with individually? (E.g. separate individual claims/letters.) Or should/can we write one letter for all 3 accounts? Or one cover letter, with 3 attached claims/letters!

    I wasn't sure what the best method for reclaiming charges would be. Especially, if we had to take court action and whether by sending three separate letters/claim, it would mean 3 individual court claims.

    Any help/advice/guidance much appreciated.

    Hi, can anyone tell me if the 14 days given on the second letter asking for charges back includes weekends. I am just in the process of writing my Letter Before Action because I have had a lot of messing about, with not finding my letters and faxes etc. The claim was originally sent and dated the 14th March, but halifax have today informed me they now how relevant letters and it was logged onto there system on the 27th March, So this according to them is when the claim originates from, Although it has from my dates taken them 13 days/ 14 tomorrow to find and log my letters onto the system. My Question is 1: Do you inlcude weekends
    2: Do I now send the LBA giving 14 days to reply. And if they dont file a claim.
    Any info would be greatfully received.

    You can write one letter with details of all three accounts for the stages before court but I am not sure about at court stage. I think it needs to be 3 seperate claims at that point but someone else may be able to advise you on that. Hopefully it wont get that far though. I've only seen 4 cases in 115 reported in the success thread (up to about page 98) where it has, the majority are settled in varying degrees and some have been settled by First Direct after just one letter.

    Remember to send all letters recorded delivery (signed for). Good luck :)

    Advice on this varies as to exactly when to time the days. Some say to take it from the date they have received the letter. However, when the bank deal with you it does not always take into account this courtesy and you may have received letters stating you have 7 days to reply dated 5 days previously so giving you only 2 days in reality. I know I have in the past.

    On balance I personally would allow a couple of days after they say they received it , or in the case of recorded delivery after they are proved to have received it. I'd allow maybe 14-18 days in reality and take it from there. I wouldnt delay any longer though. I would include weekends simply to take into account possible postal delays and be fair. Any extra time you give is a courtesy and it is up to you how long.

    Spoke to MCOL this morning asking why there was now no need to complete the AQ. District Judges are deciding that they are 'a waste of time', the Defendants don't turn up and they (Judges) are becoming cheesed off with
    the Banks. Of course the DJ can still ask for an AQ to be completed when the
    case is transferred to a CC nearer your home address.

    Maybe this is all good news for us claimants.
