hey there. i kinda understand how to go about making a claim.
in the last year ive had 5 unpaid direct debits for £38 each. the 5th was on thursday just gone.
am i able to make a claim to get back the £190? considering i am 20 and in college, it would come in handy! even if i was even offered £100 ill be happy!
any help would be apprecited!0 -

are you talking DPA ? In which cse yes its normal, day 40 send a strong reminder and tell them you'll report them to the ICO if they dont comply.LegalBeagles0 -

i have just put my claim in to small claims .it takes five days to service claim does this mean five working days or just five straight days(i claimed friday evening after going through with the claiming process explained on this wonderful site)
dont worry about it too much - the notice of issue you'll receive from the court will have the deemed served date on.LegalBeagles0 -

Default Judgement does by no means mean they will pay you. With Abbey they will probably file to set aside the default judgement.
Have you had confirmation from the court that default judgment has gone through ? Write to Abbey and say you have default judgement (once you get conf) nd owuld they pay up please within 7 days, then they'll either file for setaside, or you can go ahead and issue a warrant for the money.LegalBeagles0 -

21 days is allowed in the preaction protocols. Your two letters prelim and lba add up to 21 days so send your lba when your timetable dictates and see what happened. still nothing after the 21days you'll be ready to file in courtLegalBeagles0 -
hey guys,
My case with Lloyd's TSB is being transferred to my local court and I am filling in an allocation questionnaire.
What do I do now? I have got a load of writing (10 points) from the banks solicitors saying how they think the charges are fair and lawful etc.
Any advice appreciated!
Keep going - get the AQ sent off and wait for oyur directions from the court.
Do the bank mention lack of particulars/ strike outs / part18 etc etc ???? (oh that'll be the defence I expect)LegalBeagles0 -

thanks for replying. I have had a 'notice of judgement entered' from moneyclaim online. the date of this was 28th march. i did ask for immediate payment. what is 'setaside'? plus what does a warrant involve?

received my print out of transaction history off blackhorse - paid off loan 2005.
cant see any charges on there although know there defo was - anyway i defaulted on payments and done a period of reduced amounts as agreed with them
payment before i finished loan they sent a letter charging £175 - collect activity fee - i remember at the time being sooo angry as they didnt send me to a debt collecting agency just from one department to another in there head office in cardiff and couldnt understand how it could cost so much - but as we did back then we just paid up and thought there was nothing we could do
can i claim for this?
all help would be greatly received

I have sent the first letter to barclaycard. Their reply was that they cannot find my account as if it is closed it may have been deleted. The account was closed several years ago. Can they do this? How long are they supposed to keep information on accounts after they have closed? Can anyone help?0
