Can someome please tell me which MCOL form you need to fill in to start claiming in court as i have read different posts and there seems to be different ones.:o0

Hi, i dont know about different forms, i just registered details at MCOL & then you start new claim. here is the link to register. once you do that you log in to it as an account and can start any amount of claims, its pretty straight forward

We've done the first two letters as advised, and Abbey have sent a letter 'offering' £1148 against original claim of £4773.21. I say, 'offered' as they had actually transferred that amount before we even received the letter. We don't want to settle for less than a quarter of the original claim, but if they've already transferred that amount, can I still go ahead? Do I just write saying 'thanks very much but still claiming the outstanding amunt, and take them to court for the difference?
Write and tell the bank you will accept the amount in partial payment and without prejudice but will be continuing to court for the remainder.0 -
So far had relative success with Barclays Bank (altough i settled for £910 out of a total £2050 as i was off work sick at the time and desperate for the money) and also total success with Marbles card for the sum of £385.04. They provided statements free of charge, made one feeble attempt at settling for less, then paid in full once court action was threatened, although it was a gesture of goodwill and not an admission of liability (yeah right!!!)
Barclaycard have failed to provide information within 40 days and have now been reported to Information Commissioner.
Virgin credit card (aka MBNA) made payment of £100 against a bill of £211.96 and refusing to enter into further discussion, so commenced legal action.
Similarly Capital One offered £102 against a bill of £324.47. Commenced legal proceedings and they have indicated they intend contesting all of the action. Offer withdrawn.
Lloyds TSB Credit card offering nothing. Lloyds TSB bank not even acknowledged letter yet.

My case with Lloyd's TSB is being transferred to my local court and I am filling in an allocation questionnaire.
What do I do now? I have got a load of writing (10 points) from the banks solicitors saying how they think the charges are fair and lawful etc.

This is because the thought of going to court has worried people into accepting less than they are ENTITLED to.
Abbey are difficult - not particularly more so than others (except natwest and RBSS who at them moment are quite simple)
Abbey are likely to take you up to the court steps. They are likely to defend, enter AQ's, and let you comply with directions before settling a couple days before a hearing.
Abbey do turn up to prelim, allocation, case managment and directions hearings.
You will win 100% of your charges back plus 8% interest plus court costs, stick to YOUR timetables, follow the process, and comply with orders from the court....and be patient and do not let the thought of court scare you - the judges are as hacked off with them as we are, and Abbey won't show at a full hearing for a standard bank charges plus statutory interest claim...but be prepared to take it to the steps of the court.

i have just put my claim in to small claims .it takes five days to service claim does this mean five working days or just five straight days(i claimed friday evening after going through with the claiming process explained on this wonderful site)0 -
