    Hiya & help. Have just filled out MCOL and site advises it takes 5 days for the claim to be 'serviced'. There's a bank holiday (HA HA!!) coming up - will this affect the times scales of waiting etc??

    HI, Sorry I'm new to all this!
    I am aiming at Abbey first! I sent the first letter and got the "I'm sorry you have a complaint - we'll look into it" Sent the second letter got no response so filled in moneyclaim online. Theyhave filed a defense and I have been moved courts from Northampton to Southampton. I have received notification of this from Northampton. The paperwork says the allocation questionaire is not necessary unless ordered by the judge at the new court.
    Any one else had this happen? What does it mean?

    have you had a reply from them yet. I hrequewsted my account number (as its a closed account) and they said they would send it in the post (delaying tactics I presume as I haven't heard yet from them 3 weeks later)
    but in the meantime I have managed to find my account number I think, so !st letter going off tomorrow.

    Bank holidays can affect the timescales.

    Just claimed from barclaycard on a closed account -didn't seem to cause any delay
    I did have my account no to quote though and copies of statements so I could list charges
    They have offered me half my claim and paid up but I am continuing to court stage for the rest

    Don't you have your statements to check yourself? - you could be missing out on claiming charges!

    W/end and Bank holidays can affect the timescales :)

    Q. I am entering judgment by default but a message comes up stating you cannot enter judgment by default at this time, why does it say this?

    A. This is because the defendant's time for filing a response has not yet passed. If their deadline fell on a weekend or bank holiday they are given the next working day to respond. It may also be because the defendant has filed an acknowledgement of service, which gives them an extra 14 days to respond.

    :confused: I did send my account no. although I have no statements or anything else.

    Hi guys,

    I have been going through this process for a while and at the last minute Lloyds TSB have acknowledged my claim and put in a defence disputeing the whole amount i am claiming? (£3200)

    Is this normal and what happens next timescale wise?

    Also i have emmigrated from the UK last week and now live in New Zealand, will this affect anything? if i have to go to court can i send a representative?

    Any help and advice would be greatfully appreciated.

    There is a post on page 241 #4816 where this happened also to someone. Filing and paying for this part of the procedure does take time so perhaps it is a relatively new approach by the courts to get through the cases quicker ? Just a thought and someone else may have more definitive information for you ...good luck :)
