    ok sorry am still trying to cram all the facts in my head is it ok to ask a few thick questions!!!

    Q1. i get child benefit and housing paid into my bank it was only until i read a post before something about they should not be allowed to take charges or money from these payments, sooo when i write my letter do i make sure i include this info!

    Q2. i have lots of charges or 10.00 for reversal of loan payment (same bank) do i just accept these charges? as the money was not there on some occassions.

    Q3. you can go back 6 years right? do i just ring my bank up and ask them to send me 6 years worth of statements?

    cant think of anything else right now thank you for your help though everyone!

    You need to read Martin's article and follow the step by step guide in it and use the template letters therein.

    I have just filed a claim with MCOL against Abbey but don't remember seeing anywhere that asked what court. Does this come when they confirm the claim or have I messed up!!!!

    Initially MCOL will file it at their local court which is Northampton and if it goes further it will then be transferred to the court nearest to you.

    Thank you for this. I thought I'd read something similar before in another post a while ago but needed reassuring. Now for the nail biting bit.

    I guess there is nothing stopping me filing a separate claim for the other amount too.

    It was the deadline for Barclaycard to send me my statements today but didnt even though they cashed my £10 cheque 3 weeks ago and I havent heard anything from them. Is it worth calling them or will I just get the usual fobbing off response? Should I just report to the information commissioner and if so is it under Freedom of Information that I complain.

  • We've done the first two letters as advised, and Abbey have sent a letter 'offering' £1148 against original claim of £4773.21. I say, 'offered' as they had actually transferred that amount before we even received the letter. We don't want to settle for less than a quarter of the original claim, but if they've already transferred that amount, can I still go ahead? Do I just write saying 'thanks very much but still claiming the outstanding amunt, and take them to court for the difference?

    The letter seemed pretty standard, Sorry you're unhappy, gesture of goodwill, do not contravene the Unfair Terms, are not unlawful, charges sre for administration, etc.etc.

    Sorry if this has been asked before or I've missed it in the articles!
