Reclaim Unfair Bank Charges Discussion Area

Hi,
Is it harder trying to claim charges back off credit cards. I have sucessfully reclaimed Mortgage Exit Fees and Bank Charges without any hitches and to my surprise very quickly only took two weeks at the most and still have my bank account in tact, well so far anyway.
I have read some of the posts and people are struggling with credit card charges, if it gets to the taking to court stage do they back down?
I only have credit card charges to have a go at now and if it works I will be very pleased indeed. Are there certain credit card companies that don't like paying up? Please let me know the ones who are being difficult if someone could let me know.
Thanks and I hope everybodies claims go through as easy as mine did.0 -
hi all
i was told today by a work friend, that if you reclaiming unfair charges from a bank that you have also a mortgage with you have more change of getting the full amount and there is also less chance of the bank closing the account.
can anyone tell me if this is true
many thanks

The banks, shouldn't be closing people's accounts anymore, unless they want to pay out compensation, as well as the refund.

Default Lloyds TSB - Goodwill payment
I have got to the court stage with Lloyds TSB who owe me £2500 in unfair charges. They have filed a defence so am now just waiting for a court date. however I have just checked my account and they have paid in £750 as a goodwill payment. I have received no information about this so haven't signed anything, but my worry is that if it goes to court they might turn around and say that I accepted this payment and am therefore not eligible for any more. Has anyone else had this with Lloyds, and can you advise on the best course of action?
ThanksMama

I can't believe that!!! Even though it's always nice to get some money ... I think that it seems highly unprofessional to change your balance when you have not actually agreed to it! They really are trying it on.. who are these people who work in these banks! (sorry I'll try not to get emotional). I would advise keeping records of your statements continually and seeking further advice from someone maybe on here who has had experience of this and knows what to do. And keep records of the letters you send, and the letter you send specifically which you'll state that you do not agree to accept payment in part but charge them interest on top as some people are doing and then, if needs be, take them to court. Keep following the process MARTIN MSE suggests.
watch martin here & read the full claim your charges back link (again)
STEP 3 OR 4 IS FOR YOU MAMA (not sure which step you are on, i guess step 3).
as for katie.. I THINK you need not worry too much, just keep the statements as your own proof in court and mini slips out of the cash machine even! I guess this means you have paid the £120? Keep strong. Good luck.
Thats all I can say on the matter!:www:If you've got time, please sign the government petition online that 'ME is Real'HALIFAX Statements request letter sent 30 March. Statements received 05 June 1st Letter sent 03 July 07 2nd Letter(threaten court action)sent 17th July 07

I sent the first initial template letter to Barclays asking for a list of charges and i put that they could deduct the charge from this from my bank account (i'd mislaid my cheque book - found it now!!) and i sent it almost 40 days ago now via recorded delivery but i can't find the slip (arrrghh!!) and i haven't heard anything back from them at all.. Do they usually wait until the last minute to send the statements/list of charges? Do you think they haven't bothered because i asked them to take the fee from my account instead of sending a cheque? What can i do now??0

i have a poor recent credit history with lloyds and cap 1. I recently cleared Cap 1 at 50% but still am in negotiations with lloyds re o/d and credit cards.
so do i have the right to now approach cap 1 and ask for refund of charges given they discounted debt by 50% and would they find favour with court if it went that far.
re lloyds (a/c closed and defaulted), they have offered a discounted figure (80%) and i wonder how my approach re bank charges might affect their dealings with me.
i would add that these debts were/have now been outsourced to debt collectors (sold on) so i am not sure re their level of interest in how debt is collected.
im am concerned about courts stance if lloyds/cap 1 called my bluff, would they come down on lenders side given my credit history?
appreciate your views?
