    hi I have come in from work tonight to find a letter from Lloyds,you know the one, we are dealing with your complaint blah blah blah, i am going to send the template letter not happy with your response letter tomorrow, but I have acumualated £896 on my account,would it be worth mentioning in a paragraph added to the template letter that my first letter was not a complaint,just a request and that the only money being paid into my account is CHILD BENEFIT& TAX CREDITS.( my wages fortunatley get paid into a different bank) am i right in saying that the bank is not allowed to take any of that money from me as that is what GOVERMENT say i NEED to live on

    You can always add this:

    Social Security Administration Act 1992
    Miscellaneous
    Certain benefit to be inalienable **

    187- Subject to the provisions of this Act, every assignment of, or charge on-
    (a)benefit as defined in section 122 of the Contributions and Benefits Act;
    (b)any income-related benefit; or
    (c)child benefit,
    and every agreement to assign or charge such benefit shall be void; and, on the bankrupcy of the beneficiary, such benefit shall not pass to any trustee or other person acting on behalf of his creditors

    Taken from a template here:

    http://www.consumeractiongroup.co.uk...-benefits.html

    The template must be amended to suit the name of your benefit and apparently must be sent in each time there is a payment due in to stop them taking anything from it, but that it worth the hassle to stop them.

    They are breaking the law taking social security benefits. Good luck :)

    WOW I never knew that, I had my baby in July last year & I got tax credits paid in while he was in SCBU (Special Care Baby Unit), NatWest took over £250 in charges, took me over my overdraft, things snowballed as you can imagine. I'm going to print out what you have said & use the information if my claim goes to court. Thanks Twinkly as always :beer:
