    quick question - trying to claim for returned dd with abbey mortgage
    dec gave 10working days notice my pay day had changed but they still applied for dd and it was returned. 2nd this month wages was late so
    I rang them on the day it was due out to explain and said it would be a day
    late paid it the following day.
    have had two charges do you think I can claim.
    also wondered if we are being discrimated by some of the banks surely if
    one person is paid back all charges and we all have the same t&c on our accounts, we should all be paid back. Is this why they are trying to avoid going to court ? since if xxx bank gets found unlawful it will open the gates for other account holders?

    The Abbey letter just said 'thank you for contacting us, and sorry you had to complain', etc. It then said it would be looked at by a team member, and they did say that These Things Take Time, and they would contact me in 4 weeks' time, (Letter was dated March 14th).

    So do I give them the 4 weeks (bearing in mind the OFT Ruling may intervene), or should I progress the matter?


    A quote from Martin's template letter.......

    "I wrote to you on [INSERT DATE], making the original request for a payment in settlement of my claim.! As I have not heard from you/not received a satisfactory response [DELETE AS APPROPRIATE], I am writing to inform you I intend to claim the full amount claimed together with interest up to the date of judgment and court fees in the proceedings through the county court."......

    In your case you would write " As I have not received a satisfactory response". Remember if the 14 days are up from your initial letter then continue with the next step.

  • Thanks Sammy 7 for the advice to ring hsbc on 01226261010, i got through to them and they said they had received my letter which was a template from this site, requesting bank statements going back 6yrs.They could see that three or four statement,from 2005 had been sent out to me .They also said a letter has been sent to me on the 8th April as there was some confusion as to what i was actually requesting !!. I have never received any such letter, however they have agreed to send out statements BUT they may only have it on file as me requesting them from today,in effect that gives them 40 days grace again. Talk about delaying tactics. So here I am back at the very beginning again

    You are taking the bank to court because the charges are excessive and disproportionate to actual cost. The bank would be entitled to do exactly the same thing to you. Think about it.

    Hi, I am making a claim against LTSB For £2800 and have submitted my claim with MoneyClaim. Can anyone tell me if MoneyClaim write out to my home address to let me know if LTSB defend the claim or do I have to keep checking online 14 days after submission.

    I dont actually know if they write to you but I wouldnt be able to control myself from sneaking a peek online every time I went near the pc :)

    I kept checking on line, and they did put a defence in against me, and i got a letter a few days later.

  • Hi I am now at the stage of sending my threatening court letter as RBS had till today to reply, should i seek a lawyer first then snd the letter or send it away today? any help appreciated thanks

    No you won't need a lawyer.

    Send the letter then if they don't reply to that you can just start your claim on MCOL. It's really easy :)
