I've been trying to recover my bank charges (£640) from Abbey and have written to them, asking for charges, written again and then threatened to take them to court. On each occasion I have had a reply saying "we have been upfront about our charges so NO" basically.
I am now starting the court process via moneytrain and wonder about the legality of me sending a letter, recorded delivery, advising that should it go to court I may charge upto £640 per hour, or part thereof. I agree this is extortionate but should Abbey contest and win I then produce a copy of the letter, the recorded delivery slip and an invoice for the said amount on the basis of "I have been upfront about my charges..."
Any advice on legality of this appreciated

Iam with hsbc and i sent a cheque off on 28th Feb requesting bank statements for past 6 years-a week later i had the cheque returned and was told my statements would be sent in batches so far i have had 4 months worth dating back to 2005, and nothing more , any suggestions where i go from here ?
If you have online banking with HSBC all your statemennts for the last six years are on there, no need to request/wait for them...
go into your accounts list enter your current account then on the left hand side under my account there is a list one of which is my statements, click on this and you will then have access to your last 6yrs statements...0 -
Hello, I have started the initial reclaiming bank charges process, I sent my original statements outlining bank charges. I have heard nothing, I have even asked for my statements to be returned but have had nothing. Can I continue to the next stage of threatning court action without these statements?

Think i read that for the court claim you should put the registered head office go to the reclaims help thread where it deals with this....

Little bit more help needed please, I need to write to the court today to ask for an extention in handing my allocation questionaire in, is there a standard letter to send, or if not could someone give me a few clues as to what i need to put in the letter.

anyone out there having problems with banks dragging their heels over sending back info?? have included a cheque for £10 when requesting list of charges incurred at the bank of scotland,,,,32 days,,still waiting0

The Abbey letter just said 'thank you for contacting us, and sorry you had to complain', etc. It then said it would be looked at by a team member, and they did say that These Things Take Time, and they would contact me in 4 weeks' time, (Letter was dated March 14th).
So do I give them the 4 weeks (bearing in mind the OFT Ruling may intervene), or should I progress the matter?0 -

Keep to your timescales not their's. Personally I'd carry onto the next step.

I'm not sure if I'm right, but I think that as long as you have started your claim before April 07, the OFT ruling shouldn't affect it.0
