Hi Redruby i followed some advice from peeps on this site and looked on the 'Consumer Action Group' site. It has alot of information and letter templates for different stages of claiming including how to fill out the Allocation Questionare and legal advice. Hopefully that will be of some help to you. Hi Hanson1 I'm claiming from Llyods and have put in a claim through money claim online they have until 2nd April to enter an acknowledgment or defence. I received a letter saturday offering me £750, but having asked for advice on this site and the Consumer Action group site I will be going for the full amount of £1486.00. It seems to be that some banks send out standard letters offering roughly the same amount!! So i say stick to your guns and go for the full amount. I kept in my mind that as far as I'm aware no one has actually gone to court and claims have been settled one way or another before actually getting into court!! Does that make sense I hope thats been of some help to you??? Suzy0

Hi All, Could Someone Give Me Some Advice Please. Barclays Owe Me £1310.00 Just Talked To Them On The Phone And Theyve Offered Me £985.00 . If I Send The Letter Which Threatens Legal Action, Claiming £488.00 Interest On Top, Does Anyone Know If They Make A Second Offer Or Do They Tell You To Shove It.
If the amount they offered is the amount you are claiming without interest then you have to accept it. You arent entitled to claim interest unless at court stage. If the amount they have offered is lower than the amount without interest you can decline and try for the full amount. You may have to go to the court stages to get it but its up to you what you will accept. Good luck0 -

You have given me some great advise these past few days, I have realised that the letter that HBOS sent me before I sent off my LBA was from Halifax, I have sent my LBA to BOS head address in Edinburgh, I wondered if this mattered or would I have to do it again and send to the other address?BORN TO RIDE - FORCED TO DRIVE

There was no date stated when the monies would be paid, just the following:
I accept the sum of 2444.66 in full and final settlement of my claim against HSBC for the charges applied to my account in the period from 5/01/01 to 30/01/07. I agree not to make any claims relating to charges for period above. I also agree to keep the facts of my claim and offer strictly confidentail :rolleyes:
This was a letter from a firm of solicitors for HSBC, and I must have phoned 20 times today and got their voicemail :mad:

Hi all, just seen that Lloyds TSB has acknowledged my court claim and have a further 15 days to respond. I'm seeking to reclaim @ £1,300 but have had no letter or offer.... are they just wasting time or do you think they'll enter a defence? :eek:0

As regards this question I dont know the difference between HBOS and BOS so I darent comment sorry.
Edit: Just thought about it and I dont need to know the difference do i reallyIf I thought I had got the wrong address for something I would just send a copy to the other one and explain that in the event of any error this letter was a copy.

I can see they are messing you about and you're fed up with up it. Personally I would write a letter today and send it recorded delivery before todays last posting. I'd state that I withdrew my acceptance on the grounds of deliberate and persistent non-communication and failure to pay the settlement in a reasonable time. I'd advise I was filing court claim and do it. Get the lot back & interest & costs. You owe them no favours.
But thats me ....
All you can do otherwise is wait until they deign to talk to you.
