    Can anyone tell me if you can claim charges placed on a loan for unpaid dd and late payments

    Hi,

    I posted a question last week regarding Capital One and got some great feedback, thanks for that.

    In the mean time i took the advice and declined their offer of £288, and requested that they pay the full amount of £800 back or i will take legal action. On Saturday i received a letter basically saying "go on then, because we are not paying you anymore charges back". Normally i would file a legal action straight away, but i am worried about this announcement from the OFT and how that will effect the banks defending themselves in court?

    Would anyone else still go ahead with this or is it too close to this announcement to move forward?

    Any ideas?

    Hi, new on here.

    I've seen on Watchdog that you can claim charges for not paying by direct debit for some companies like BT, Sky, Virgin and mobile phone companies.

    I just wondered if you can claim things like that fromother companies?

    TO cut a long story short, I (very stupidly) got a loan against my log book of my car. They are now charging me £12 every single week that my payment isn't with them on time.

    I originally paid them weekly when I was getting weekly pay but I've gone on to monthly and they say to pay monthly you have to pay one month in advance which I can't afford to do.

    To top it off, original loan was only for £750 - it now stands at about £1500 including interest and their £12 charges per letter.

    Anyway, my question was whether you think I could reclaim these £12 charges for them having to send me a letter saying they haven't received my payment that week??

    Any thoughts appreciated.

    I know this isn't strickly bank charges however i feel i have been unfairly treated and wanted some feedback.

    Basically i requested my existing booked holiday with Thompson to be re-scheduled for one week earlier (was 12-26, now 5-19th June 07). I was told i would be charged £35 per re-book (£105.00 total) extra for the service (which took less than 20 mins to complete over the phone):confused: .
    I have already sent off a version of letter 1 requesting it all back and i am prepared to re-visit MCOL after my recent victory over HBOS. :D

    Am i justified in re-claiming as i feel £35 isn't a true relection of the admin cost and is therefore unfair.

  • My boyfriend sent the template letter to lloyds asking them for a list of his bank charges for the past six years. From the list they sent we calculated that he has been charged £240. I know we haven't started his claim yet but I was wondering if we have to go to court would this list of charges be enough evidence. Should we ask lloyds for his actual statements?
    I know it sounds premature but I just want to be prepared before we send the first letter.
    I'd be grateful for any advice.

    Time to send your letter before action (LBA) and combine these charges with the previous ones to give a new total & interest that you will claim in court.

    i'm by no means an expert and am only in the initial stages of claiming myself but if you read the posts on these forums i'll think you'll find that people will recommend you go ahead with your claim you'll probably be offered more before court... totally up to you of course

    The OFT announcement will not change the law. Only full disclosure of bank costs will make any difference and it would have to be done in court against one of these claims. The OFT announcement wont change anything in that regard.
