  • I have read through as much as I can, I have also been onto consumer action group website. And....

    I am just filling in my allocation questionnaire (HSBC £3666.68) and is it right that I put in Part G - My question is, is this all I put in part G and nothing else??



    I believe this case will last no longer than one hour.

    I am respectfully requesting that my claim be allocated to the small claims track. This issue is not a complicated one; it is an issue of fact and not of law. The issue is only whether the money levied by the Defendant in respect of its customer’s contractual breaches exceed their actual costs incurred. I am happy to pay their actual costs and I am surprised the Defendant did not counterclaim for these, because I would have paid them without argument.

    However, the continuing problem is, (in common with the 100s of other cases currently being brought by other bank customers), that the banks refuse to reveal the details of their penalty-charging regime. As the banks have a fiduciary duty towards their customers, they have a duty to deal straightforwardly and in utmost good faith.

    Accordingly, I would respectfully ask that the court in this case, not withstanding allocation to the small claims track, order standard disclosure. I understand that it is in the courts discretion to do so. This would bring a rapid end, not only to this litigation, but would also likely bring an end to much of the litigation in progress against other high-street banks.



    If i have to write something else, could someone give me an idea of what to put.

    thanks taffyfella great help!!works out from sept 05 to july 06 £650.00 fingers crossed will update all when i next hear from them in the mean time i am going to read up more about the next stage :) wish me luck!

    After the bank have acknowledged your claim, do they have a further 28 days or a further 14 to make the total time to respond 28?

    I wish you the greatest of luck, if you need any help or advice give me a shout. I've litertally just put a claim through MCOL and waiting for it to be served.

    I have read this forum intensly and educated myself up til now. This is where I shout for help!!!!

    Welcome to the forum,


    You can post to your branch or the customer service address you may already have, either way your letter will be sent. If they reply to any correspondence sent it'd more efficent to reply to address where it came from.

    The service charges for this type of account can't be reclaimed however the charges resulting from the service charge can be so it depends if the offer covers all the charges as to whether its reasonable or not.

    Newbie to the site and have to say, Martin, what a fantastic site and a great thing you're doing!

    Anyway....Sent in my first claim from Nationwide of £2222.87 and have to say I feel a little......nervous!

    'tis funny. When I read what to do I was full of bravado......y'know, the old 'yeah, c'mon. Bring it on! Power to the people...' an' all that but since sending offf my claim I'm feeling more like a little boy.

    Ho hum.....here's looking to my new Flat Screen TV and PS3 when the claim is paid! :D
