Can anyone please give me some advise.
I have a HSBC credit card and an HSBC account that I am claiming charges back for. I am now at the court stage and need to know do I put them together or do I have to do two seperate court processes?

Has this happened to anyone else with the Halifax. I claimed £2563.00 in charges and they made me an offer of £1842.00 which I turned down. I started court proceedings which cost me £120.00 this time I added on interest which brought the total up to £3315.52. I received a letter from the court on 15th March saying that the Halifax were defending all of the claim and they have 28 days from the date of service to file a defence. I then received a letter from the Halifax dated 23rd March saying sorry I was unhappy with their offer of £1842 and offering me £2563 in full and final settlement. Well I would have been happy with this if they had offered it to me in the first place but now I have paid £120.00 court costs how do I get that back if I accept their offer. Should I just carry on and let it go to court, I'm not being greedy and only ever wanted back what they had taken but why should I now be £120.00 out of pocket.
You are in a position to ask for the full amount & interest & £120 court fees. If they refuse you havent lost anything and the court will award this after judgement. Wanting interest isnt greedy it was your money to start with. Keep an eye on the claim as to days left for them to file a defence and if they dont you win by default. Good luck0 -

Not sure of this but I think they need to be seperate. Get a 2nd opinion, i've answered best i can and didnt want you think I was ignoring your post since I've answered everyone elses this morning sorry0 -
Hi can anyone please help me?. I sent the first letter to Halifax requesting my charges back totalling 2330 pounds. It has been 2 wks since sending this. I have had no response at all, so phoned the bank to ask what was happening. They said they had not received my letter, although it was sent via recorded delivery and has been signed for. I was asked to send it in again, SO DID a second time, AGAIN said they had not received it although Again signed for. Then they requested a fax of the details instead (to get there safely) I sent them the fax and this morning I was told they had not received that either. I asked them what they propose to do and was told NOTHING because we need it in writing that you wish to claim. To top it all off I received a letter from Halifax Trininty rd, saying my account was overdrawn by 76.53 and that they would close my account on the 7th April if I did not rectify this. This has upset me as the 76.53 was paid within 24hrs of me knowing. And secondly it was there fault as they let a standing order go through 4 DAYS early, with NO MONEY IN MY ACCOUNT. They had the cheek to charge me a further 39.00. Can anyone advise what i should do now please. I have been patient and tolerate, but surely from the 3 letters / faxes etc they should have received at least one of these. CAN ANYONE PLEASE ADVISE WHAT TO DO NOW.0

I am with Barclays banks, and i have the marjority of my statements, but
I m missing 44 pages. Should I ask the bank directly for these 44 pages or should i send martin Lewis's template letter with enclosed £10 cheque?

I would bet my bottom dollar they have received your letters and are stalling. Closing your account over an amount deibited from the account in their error is clearly retaliatory. With regard to the original amount claimed, amend it to reflect all new charges and send the LBA (letter before action) by recorded delivery.
Dont let them mess you about like this you dont need the stress of it. Stick to communication in writing only and keep to the timescales from now on. Good luck
Edited to add: With regard to closing your account over a direct debit bounced outside of its due date and the subsequent charge. There are two issues to address not one.
1) You are protected under the Direct Debit Guarantee here and if they went in early it is solely the banks responsibility to ensure a direct debit is not paid in error. The issue isnt whether you had the money available, it is that the date was wrong.
2) The charge is unlawful regardless so reclaim it.0 -
Sorry about this but I have completed a claim against Lloyds TSB on this site but did not get the customer number so I cannot log on to find out what is happening. Can anyone tell me if I can find this information anywhere0

Thanks for the reply. Would it be best to just ignore the offer of £2563 and wait for the court to award me what I am asking for or should I contact the Halifax and tell them I am now £120.00 out of pocket and that I have also asked for interest. Must admit now I am using MCOL I would rather not correspond with the Halifax as I have only ever corresponded with them using Martin's template letters and there isn't one for this situation.
It is much less stressful to deal with them in writing and if I may suggest an amateur template it would read like this:
Dear (whoever signed the letter making the offer)
With regard to account number XXXXXXXXX and recent correspondence received.
As you are aware the matter is in court proceedings at present. I respectfully decline your offer of XXXXXX and remind you that interest and court costs are now payable in settlement in full of this claim.

As always, keep a copy and send it recorded delivery.

You could try it but they would be likely to send statements and charge you for them per statement. Its best to make your request a Subject Access Request under the Data Protection Act for which there is only one fee of £10 payable and you must allow 40 days to receive them.0
