  • Hi I have a barclaycard but i do not have any of my statements my credit limit was £500 but the charges and intrest which have been added have taken it to £1495.00. can't afford to pay £3.00 per copy of statement what can i claim back or should i try for the whole £995 and see what they say?

    You don't pay £3 per copy, read martins article and use the first template, under the D.P.A you can ask for the last 6yrs charges for a max of £10 in total. but you must make it clear it is under the D.P.A......


    You can claim late payment fee's and over limit fee's but not interest..
  • Hiya All. As a newbie, and gone through the process of getting my statemenst through from Data Protection and all that, I am now at the stage of frustration. I have three accounts with Lloyds, one active and two closed. Now, Having written to the banks, ( three different branches of Lloyds) I have heard NOTHING at all. They have had ample toime now to respond, and indeed, I KNOW they have recieved my letters from the "special delivery" post. As my next intentionis to throw Lloyds TSB into a court hearing, what I need to know is this.

    Although each of the seperate accounts were with different branches of Lloyds, would I be right in assuming I can total the WHOLE amount of ALL the accounts that I have had charges to, and cite the MAIN head office of Lloyds in Gresham Street, London, as the one I name to apopear in court?

    OR:, will I have to individualise each branch, and apply for THEM to appear?
    My totals add up to £2980, so its worth doing right!!

  • As a footnote to this, it is my intention to use the Moneyclaimonline service to deal with this.

    Hi I also sent the first template letter to the Halifax and got a reply today on the 40th day exactly saying my list of transactions will be sent out and if i have not received by the next 21 days I have to contact them .I think they are just stalling everyone JH
  • [They have 40 days to provide the information but there is nothing to stop you reminding them that you haven't had it.

    Thank you Edinburghlass for your reply on 25/3 to me. I haven't had time to get back online, however, whilst in at my branch yesterday paying a bill, I asked them to check whether they had received my letter and cheque for £10 requesting charges dating back 6 years. The girl told me there was nothing, but after checking with a senior member of staff, I was told that (conveniently for them, but not for me), that as there was such a backlog of 'reclaim letters' at the branch that they had received it 'today' (yest), and that my 40 days would take effect from yest, even though they would have received it on 28 February. Should this affect my claim when I send 'stage 2' of my reclaims as it will be almost End May before my 40 days are up, and are they allowed to count 40 days from yesterday. I hate to say, but the 'senior member' of staff, is the horrible woman from hell who thinks she owns the place!:mad:

  • My god, having read loads of your threads on HBOS, I don't hold out much hope for my claim, which I am sure will be a fair whack, and I don't know whether I can have the energy to hold out as they just peeve me right off good 'n' proper. I am sure this is their intention, and that people will just back off. You all give me strength though, and I will see this though, even if they do 'hit me' with a load of 'mince! HBOS and other banking institutes have a bloomin' cheek. They should ALL rename themselves to

    ROBBIN' U BLIND!

  • Can anyone help with our problem??

    My boyfriend has an account with the Yorkshire Bank, last year we transferred all the direct debits from this account into a new joint account with a different bank. One 'slipped through the net' going out of the Yorkshire Bank account leaving the account over drawn by around £70. The over draft limit on the account was £150. Due to an oversite on our part the overdrawn amount of £70 got left for a few months. We received a statement in feb showing the over draft of £150 being taken away and a daily charge on £8.00 being applied to the account. Taking the amount owed to over £200. When we spoke to the Branch we got a non plus response to why the over draft had been taken away and were given several dates during the one conversation ranging from some time in 2004, Nov 2006 and Jan 2006, we have all the statements from the past months but NO letter notifying us of the overdraft being taken away. They also could not offer any explanation as to why the stupid charges of £8.00 a day had been applied to the account. On the 12th March we went to the Branch to pay the money owed on the account (out of savings) of £244.00 and asked how to make a complaint and we were given a leaflet. During the next week or so we have been collecting all the information we need to make a complaint. The next statment we received at the end of last week shows another charge of £25 taking the account over drawn again and therefore charging us the £8.00 a day. Taking the amount owed so far to nearly £100. This situation is a vicious circle! Surely the branch would have been able to tell us of the additional charge of £25 at the time we paid of the other owed amount!
    Can anyone suggest what is best to do next? Pay off the amount owed again and complain requesting refund off everything? each day that goes by just means the amount owed getting bigger and bigger!

    HELP PLEASE!!

    Hi,

    I was very glad to find a full offer including court fee and interest when I got home 10 mins ago. However, there is no offer of when the monies will be paid. What do I do next.? Just send it back and wait? Do I have to call then courts?

    Any advice greatly appreciated!

    My advice is; dont pay any more. Stop using the account and dont put any money into it, use the joint account instead for any transactions that must be done by a bank.

    Send Yorkshire Bank a Subject Access Request under the Data Protection Act enclosing the statutory fee of £10 requesting all details of the bank account. Allow 40 days to receive them and then go thorugh them with a fine tooth comb and reclaim all relevant charges. You arent getting straight answers to your questions from the bank and it is highly unlikely that their complaints procedure will refund all charges. They have had their chance and fob you off. Follow the reclaiming procedure instead.
