Hi
I successfully reclaimed £520 odd of charges over the last 5 yrs, however I was stupid enough to run up an extra £100 of charges between when I wrote my letter to the bank and receiving the settlement. To be fair it is totally my fault & I am now very careful to not go over my overdraft, though they still sting you for a few pence!!! Some off my family say that i should push to reclaim this extra amount but I am hesitant.
So should I also reclaim these charges, or just count myself lucky?0 -
Asked Halifax Credit card for £165 back which they paid after sending us a letter aimed at making us feel bad!
2 days later they reduced our credit limit from £8,500 to £1,500 (50 quid over our current balance). I called them and asked them if it was because we had claimed charges back to which the Lady replied "yes"! I couldn't believe my ears but don't know if there's anything I can do about it either!0 -
Hi
Thanks for your advice. So i do i send the LBA and include all charges but miss out in the paragraph 'failed to respond' on the letter as the 2nd letter for charges was responded to?
Also, where would i find the local address for my court?0 -
I have been told by Natwest that i am going to get a full refund of my charges but the letter will not get to me until the end of April is this an honest answer or this a 'buy me some time until the OFT make a decision' answer.
Should i go onto MCOL to speed things up0 -

Yes you should, its your money after all. We are lucky but the luck is that we found out they werent supposed to be taking it, not that we got it back. Until consumer law allows banks to take whatever they feel like then we are entitled to reclaim it
Having said that though check any letters accepting settlement to make sure you didnt sign anything to say you wouldnt claim again. Good luck0 -

To your first question the answer is yes. To the second, you can leave it as 'local court' or find your local address here :

Dont take anything said over the phone for granted get everything in writing. It takes a few minutes to print off and post a letter not 6 weeks for goodness sake, theyre stalling.
If you have no offer in writing at this point you can file at MCOL. The banks cant claim that they have offered you the full amount until you have that in your hand so go for it. Good luck0 -
Has this happened to anyone else with the Halifax. I claimed £2563.00 in charges and they made me an offer of £1842.00 which I turned down. I started court proceedings which cost me £120.00 this time I added on interest which brought the total up to £3315.52. I received a letter from the court on 15th March saying that the Halifax were defending all of the claim and they have 28 days from the date of service to file a defence. I then received a letter from the Halifax dated 23rd March saying sorry I was unhappy with their offer of £1842 and offering me £2563 in full and final settlement. Well I would have been happy with this if they had offered it to me in the first place but now I have paid £120.00 court costs how do I get that back if I accept their offer. Should I just carry on and let it go to court, I'm not being greedy and only ever wanted back what they had taken but why should I now be £120.00 out of pocket.0
