    I have been dealing with two claims against Capital One credit cards, I have
    had similar letters as you have, I did issue court proceedings against one account, they didn't acknowledge or defend the claim. I issued Judgement
    against them on the 16th March demanding payment by the 23rd March. If
    nothing is received by the morning I will request a Warrant against them for
    £960.06 which included interest and court fees. The original claim was for £690, twice they offered £216 against that sum which I declined.

    I am claiming £712 on the second card, they offered me £126, I declined.
    Their last letter states their offer still stands for £126 so please sign and return the offer letter so we can save the courts valuable time. MCOL is
    being organised as I type this today.

    One interesting paragraph in an earlier letter states that the OFT haven't told them that they are obliged to refund any fees. What planet are Capital One on ?

    My advice is stick to the timetables set out by Martin.

    Hi Vicky,

    Just carry on to the next step - they tried this with me and I took them to court on 2 accounts and got full amounts back for both.

    They are just trying to get you to cave in by making you think you arent going to get anything back but you will ;)
  • Served Abbey with papers for my bank charges claim. Although they stated on their acknowledgement of service their intentions to defend the case the 28 days has now elapsed, and as far as i am aware no defence placed. nothing on Moneyclaim website under my claim nor through the post to me.

    am i able now to ask the court to enter a judgement as no repsonse by abbey has been made?

    Hi folks,

    Accepted offer from Bank of Scotland, does anyone know how long they take to pay out. It says within 14 days in letter. Anyone had experience with them?

    Thanks for all your advice on this and i have now filed a claim on MonelyClaim.

    I would have accepted the offer if they had offered a decent amount, but they been rude when i've spoke to them as well.

  • i have completed stage 3 and the bank have replied saying they will look into it and will get back to me in 8 weeks, should i just go onto stage 4?
  • Thanks for help. Have now sent off to MBNA, Access & Barclaycard, to date have had £136 credited to barclaycard, (saw statement on-line) it read, Late payment refund this aspect of the claim is £119-00 light, and there is no mention of the over credit charges which amount to £130. Have not yet had letter, but only saw this Friday (3 days after sending in claim letter) what should I do next?

    Hi everyone

    In relation to letters from solicitors acting on behalf of the banks (what some consider to be delaying and bullying tactics), are these letters sent using Royal Mail's recorded delivery service or something similar?
    I only ask because if not and the letter goes missing in the post (which lots do), surely judgements can be entered by default should you not respond to a letter you haven't actually received?

    I have not read all of this thread, but can confirm that Barclays policy is to refund 1/2 of the amount claimed. (Ex-staff!)
