I have noticed from looking through the 'Success Stories' forum, that HSBC never appear to offer the full amount claimed (I am presuming that they offer without the interest?!). :wall:

Does anyone else feel it is worth pushing for the full amount (as I do!) & if so, would that push just be in the form of filing MCOL after (& if!) a settlement letter of less than claimed amount is received?

Hope I am not covering an already asked question area, as my little eyes can only read so fast & so many pages ............. :p

    Cheers,
    Helen

I researched the success thread for HSBC on behalf of my OH. Of 113 cases I copied down:

6 were settled for more than the claimed amount, no mention of court in these cases and I assume interest was given before court.

32 cases were settled in full without the need for court and some after the first letter only.

71 cases settled for less than the amount claimed but for not much less than claimed.

    Of 4 court cases noted:

2 were settled in full by, the bank did not defend and default judgement was awarded after 14 days.

1 settled in full after court claim filed.

1 settled for less after court claim filed and it was accepted by the claimant.

Considering the above analysis I would advise to go to court but it may not be necessary.

    good luck :)

    xx

    Thanks pigsmightfly :)

I am so sorry I gave you the wrong advice there redruby. To search the forum go to the 'Reclaim Your Bank Charges' main threads page here:

    http://forums.moneysavingexpert.com/forumdisplay.html?f=102

and to search the entire forum click on the 'search' option in between 'new posts' and 'quick links' in the title bar above it and enter your text there.

I was hurrying to get to school for the small people and typed it without thinking of the correct term or a detailed explanation. sorry :)

You're welcome. Even shortcutting like that doesnt stop the old eyes getting sore if you have a lot to research but it sure helps :)

Could anyone help me out here. I am claiming almost 7,000 from HBOS in Glasgow and am now at the stage where the 14days until I take court action are almost up and I have absolutely no idea how to go about this. Because of the amount I am claiming I cannot go through small claims court and because I am in Scotland I cannot file online, could any wiser person out there tell me how I go about doing this. Do I go to the County court and get the paperwork from them or somewhere else. Many thanks.

You need to go to your local court and get speak to the people there and pick up the forms for this. However for the amount you are talking about you may well be better going through the Financial Ombudsman.

Have a read of this thread too...

Natwest have acknowledged my claim and are (allegedly) defending the whole lot. Not too concerned though, this has turned into a past time now. For only £30, i'm costing them money and making them look ridiculous with their high and mighty stance. This is £100+ I didn't have anyway so i'm not really bothered about getting it although it would be nice. I love seeing banks quiver :), especially after Whistleblower last night. How the tables have turned.
