  • We have now got as far as the M.C.O.L. with the Halifax we want charges back from 6 years totalling £995+ £80 court costs.
    We got an acknowledgment of service dated the 19th of march and the box is ticked saying that they intend to defend all of this claim.:confused: They gave a refund as a goodwill gesture last July 06 we accepted less than half of what they stole from us and they carried on charging £39 a pop.
    The thing is when they gave us that goodwill gesture(yea right) they had us sign a letter saying this was in full an final settlement.We dont belive that they could justify that sort of bribe in court,but we are a little concerned has anyone out there accepted a goodwill gesture an then later asked for the rest have we got a leg to stand on. It is still our money and they would still need to prove actual loss. The charges were made because of insuficient funds when direct debits were requested we have a basic bank account we cant go overdrawn and they charge us interest for having our benifits go in.

    They have been taking our child benifit off us for years now we have really had enough. Any body know the senario ,any advice welcome ,good luck everyone!!!!!!!!!:cool:

    Service charges i've only just realised i'm being charged £28 per month for account, it's only a basic account i don't have an overdraft facility. Like you it's my child benefit they are taking...i don't know what to do either and i'm feeling pretty peeved off.:mad:

    Today I got my list of bank charges from Lloyds TSB (£3289 + intrest),my next step is to list them and send them off, is this sent to the same address as I used when I asked for a list of all my charges or is it a different one.:huh:

    Dont feel a twit everyones circumstances are different and one persons situation may not be exactly the same as yours so checking doesnt hurt anyone :)

    Providing you have allowed the 14 days given in your first letter and are not satisfied or have received no response then my answer is yes, proceed to the second letter, this being your letter before action (LBA) in which you are now entitled to request interest added to the original amount.

    Taking them to court online with the M.C.O.L. is soooooooooo easy apart from having to pay but you get that back anyway ,you gave them resonable time now time is up file that claim its yours!!!!:cool:

They can argue that the entire claim was settled at this point and you have broken a written agreement. If you made the claim for the full amount that is now at court stage afterwards and in addition to any previous claim I believe this is fine. The final amount claimed should take into account any refunds made previously outside of this claim and be only for the remaining charges.

  • I am new to the forum. I have received a reply from Abbey after asking for £1599.87 worth of charges to be refunded (figure includes interest). I gave them 14 days to respond from 3rd March. I received a reply on 13th March. They have said they want to resolve my complaint quickly, but want to complete a thorough investigation which takes time, and they will write to me in 4 weeks, if not before!! Is this them stalling for time because they know they will not have to refund me the full amount if they can delay it long enough until this new change comes in? It will be the 10th April before they have to reply to me. I am a bit unsure of what to do. I guess I have to just sit tight until I hear from them. Can anyone please advise??

    Stick to your timescale not theirs. If their time is up, go to the next step ;)

    hiya
    i sent my letter with list of charges to halifax last week (16th march) sent it recorded delivery,have checked royalmail website to see if they have received it,still nothing??? surely they would have done by now?? anyway,when do i send my 2nd letter (lba) do i count 14 days from 16th? or later? any advice would be appreciated
