Hi All,
Firstly can I say what a fantastic site this is..
Now on to my situation, I hope someone can help me....Please!..
I have had an bank account with Barclays for around 9 years now, I have never had the benefit of an overdraft, except for the standard buffer of £10..
Now one day, a long time ago, i went to the cashpoint and withdrew a sum of money which I believed I still had in my account, to cut a long story a bit shorter, the money I withdrew wasn't there but I was still allowed to withdraw this money, taking me to around £150 overdrawn in the first instance. This was before a charge (Paid Referral Fee) of £30 was added.
Now, like many I dont regularly check my account, presuming if I cannot withdraw what I wanted, I didnt have it in the first place...How wrong I was, I ended up withdrawing more money and going £500 overdrawn, when I didnt even have an arranged overdraft, it wasnt until I received a letter stating I had gone over my £10 buffer and I would be charged no more than 3 times a month (@£30 a time) until I was within this buffer...
Anyway It couldn't of happened at a worse time for me, as I was laid off a few weeks later, meaning I had no income to get my account back in line. I was out of work for a year so my balance was getting more and more in the red.
Even though I have been in work since I have never recovered and I am still £400 in the red, I have looked at my recent statements and I have been charged £90 practically every month for the last six years im sure.
I have worked out that I have been charged around £6500 in the last six years through these Paid Referral Fee's alone, I didn't realise it was that bad, no wonder I haven't been able to get out of it!..
So, can I launch a claim against Barclays, even though I havent got an arranged overdraft?
If anyone can help that would be great?..
I have filled out the letter to send to Barclays requesting my statements for the last six years, just waiting for an ok from some of you guys before I send it..

Yes, once you get your information/statements check out post 4 in the Reclaim Help Thread for what you can claim and follow the steps in Martin's article, both are linked to in my signature.0 -

Also when it comes to the calculations, do I add the statutory interest to each and every £30 fine over the last 6 years, or do I add it onto the total amount at the end?...Because I reckon I have around 150+ of these £30 fines!!

I am currently in the midst of claiming from HSBC, and want to now open an account with someone else. Will this in any way have a detrimental effect on my claim with HSBC if they see my custom going elsewhere ? I wonder if they might think that as I'm moving they'd be less inclined to pay up. Can anyone advise please ?0

Its their job to be callous and aggressive, stick to your guns hun they can only take what you can afford. if they dont accept the £1 offer then write to the bank and say you can only afford £1 per month and enclose with that letter a statement of your financial commitments and enclose a cheque for £1 as first payment and keep paying it every month and on time, even if they dont accept, as if it ever did go to court the court would see you have made good will gestures of £1 and made an attempt to pay at least something no matter how small it is. i would also copy corrospondance to the debt collectors by post and keep copies. Yes and use the Interest Calculator entering each charge individually with the date as then the interest is worked out on each charge back to the date it was charged i.e. a charge made in 2003 will have more interest than a charge made in 2006.0 -
Hi, well i finally posted the letter requesting a full refund from HSBC today along with a spreadsheet of charges/dates/amounts totalling £2943.00
Only thing is i gave them the 14 days to respond as in the template.
Now, do i give them 14 days from receipt (i used recorded delivery), or 14 days from the date on my letter?
Any help much appreciated.
Also i never got much help to an earlier question. Can i reclaim unfair charges from my old car finance (GMAC)? i would like to know if anyone has done this before and if so have they been successful.

I am a bit confused as to when I can file for judgement by default. My claim was acknowledged by Barclays on 6th March, 13 days after it was deemed as served. Does that mean today is the 14 day deadline for them to defend it or do they get another 14 days from today?0
