    On another note I would like to know can I reclaim late payment charges from GMAC the same way I am with my bank?

    No idea about your first point, have you taken it up with GMAC?

    If you have been charged late payment fees that seem excessive then you should be able to claim these back. The article in my signature describes the process and you should be able to amend the letters slightly to reflect your situation (i.e. replace references to 'overdrafts' with 'late payment charges')

    The shortfall (£25/30/39 - £12) will be made up from unauthorised overdraft interest rates in the 35-39% (and above) region, and increases in other areas such as loan and credit card APR's. It's greed that's got the revenue to where it is now. The need to maintain profits will take over now (at least in the short term), with shareholders (the biggest being the pension funds) unwilling to accept any reduction in profits/share price/returns.
    We have to remember that we are all shareholders in some way including those that hope to rely on the state pension scheme. Maybe if som epeople see their pension schemes losing a few thousand quid due to falling margins they will understand.
    They won't close accounts down though - other than in very exceptional circumstances. They want customers on the very edge, ie the so-called 'revolvers' - those that are struggling, but still generating revenue.
    I would suggest that closing some peoples accounts down and offering them a highly restricted limited service account would be the best thing for them. Until you change some peoples mindset they will not be able to cope and if that means taking all their toys of them and nannying them then so be it.

    I also fear that all this will ultimately do is make those skating very close to the edge more likely to fall in. Thats why I keep saying short term gains for long term losses.

    OK, Remind Alliance and Leicester that they were recently reprimanded by the Financial Ombudsman for retaliatory closure of a customers account after the reclaim of charges. Make a complaint using the banks normal procedures. When this is exhausted, you can take it to the Financial Ombudsman, you are unlikely to reverse A&:'s decision, but they have awarded compensation.

    You should look at opening another current account ASAP. Unless you have particularly bad credit, you should be able to do this.
  • Hello im claiming against HSBC i got a letter today from them addressed to myself but altho the letter was adressed to me it had someones elses name and account details on it awarding them their money back ive rung HSBC but they cant find the no on Colin Langdale to give to me to ring them so what should i do? Thanx in advance jo

    can someone please tell me if they have experienced this?
    Sent a letter downloaded from this sight asking for a list of charges etc...
    i also sent the £10.00 ceque with it the ceque as still not been taken so i telephoned TSB today to see if they had got the letter and ceque...
    they said they had received my request for refund and ceque and this is being dealt with ? but i had only asked for statements in the post ?
    I also sent off for a list from the Halifax and a companey called HBOS IS DEALING WITH MY REQUEST IM LOST ?????

    ive just read my bank statement and have been charged £150 by hsbc for going over my overdraft limit... i new i was skirting around the edges (ive spent a lot recently and work freelance and not much work around) but didnt think the charges would be so high!

    i called them and was told that the charge for going over is £25 but that i went over six times... if i'd had any idea i was getting charged this id have borrowed some money from a friend or something but they didnt say a thing until my statement arrived with the charges that are going to be taken out on 2nd march (which im assuming will cause another £25 charge)... help!

    the only thing hsbc will do to stop this for a month or so (which is all i ask until work picks up) is give me a loan...

    two questions:

    1) can i dispute the charges?
    2) should i take the loan?

    Send it back to HSBC and ask where your letter is.

    Lloyds seem to be making an offer when they receive the letter asking for info/statements, wait to see what it says but if you don't get your statements within the 40 days you need to complain.

    Halifax is now HBOS aka Halifax Bank of Scotland.
