    Hi, I filed a claim against Llloyds TSB for £1412.50 on the Moneyclaim website, which cost me £120, taking the total to £1532.50.
    I recieved a letter from the court this morning saying the bank had filed a defence, with the allocation questionnaire to fill out.
    The exact wording at the end of the letter is as follows:

    "You must complete the allocation questionnaire on or before the on 07 April 2007 and return it, where the claim is over £1,500, the court fee of £100.00 to POOLE County Court."

    Do I have to pay another £100 on top of the £120 as my original claim was for less than £1500 or has the £120 been taken as part of the claim?
    Could anyone help me on this as I am very confused and becoming quite poor!!

    hello,

    im in a bit of a muddle................i sent my first letter off on the 12th of march with the interest added i have received the normal."we are dealing with your request" so monday coming i am going to send my LBA...............................thing is on the first letter should i have added interest as i have read different on other sites?!!?!?!?

    please help i dont want to mess things up!

    just a quick question
    i have a car on fianace and if they send me a letter or make a phone call they charge me £15.00 is this right and is it fair, can i claim these charges back and are they governed by the same criteria as the banks

    Natwest they have said that the money will be going to pay off the overdraft but I am paying the Debt collection company. So they have re-opened my Avantage gold account to pay the reclaimed charges into it and then they will close it again? I find this all very odd, and when I asked them are they going to tell the Debt collection company that they are clearing it I was told that was down to me - this claim is currently going through the court and although NAtWest have made an offer which I am happy to accept if I recieve a cheque and not for it to be paid into a "closed" account - I fear this is just another way of them holding onto this money!
  • Sorry I know this has been asked before but, I have had a letter from the bank (Sods law while I was away so I have to reply by the end of the week) offering me around £1250 of the £1750 they owe me (this is £1492.50 charges plus £270 odd interest) They have said this is in "full & final settlement"

    I want to take this the whole way to court and get the lot back can I accept this amount they have offered in part and then take court action? also does anyone know how much a court claim would cost for a claim of around £1800 as I'm pretty skint until the end of the month so only have around £40 to go towards the court claim. Can I wait until the 30th and register my claim or will this mess things up legally?

    Sorry to ask so many questions been away for a while and had everything happen while I've been away! :confused:

    You arent technically entitled to request interest until claiming at court so interest is requested in the LBA not the first request for charges. Not to worry because they havent replied anyway so just carry on with the process and good luck :)

    Hi, I have also just realised that the first charge i have claimed for was dated 20/11/00, and the last one was dated 09/01/07. As this is marginally over the 6 year period have I completely screwed up?
    Help me, I'm getting desperate!!
  • hello, I was wondering if anyone can help me. I have put in a claim to Barclays for around £2100. After my first letter they wrote back saying they had received it and would be dealing with it within 14 days. Within that period they wrote back again and said they were sorry I had had reason to 'complain', they were dealing with my complaint and would get back to me by 27th March. I am assuming these are just stalling tactics but I am wondering what to do next! Should I wait until the 27th and if I haven't heard anything proceed with the next stage? Any advice appreciated.

    The bank will expect any monies reclaimed to go towards any debt held by them. Have a read of the posts in this thread and the reply from CCCS that Martin received regarding any reclaim monies.

    The bank will check your list and won't refund on any charges that are out of date so don't worry about the mistake meantime as they will pick it up.
