hi
i have been following the post after purchasing 4 ipads (for me and other family members) on sunday, i obviously was extremely concerned about the situation after reading all the posts on the forum - i made these purchases as an NHS employee in good faith. I sent the site an email stating i wished to cancel under the distance selling regulations and had no response, spoke with the bank who advised it was purchased by debit card and there was no way to stop the pending payment. The bank stated that it would pend for 6 days before going back into my account.
However checked this morning and the funds are no longer pending and have not been taken out of my account. I have cancelled my debit card to try and prevent them from taking payment again in the future tho the bank state this actually no guarantee.
Hopefully other people will be as fortunate as i have been, and i have all fingers crossed that this will be the end of a horrible situation! Just wanted to let other people know there could still be a positive outcome :-)
what is the distance selling regualtions please? also can i ask how you know the payment is no longer pending? i also made the purchase on sunday but having spoke to natwest today the advisor said the payment could remain in pending for months? the natwest fraud helpline is useless! they dont even ask any details about the fraudulant site, if the purchase was made on a debit card they are simply uniterested0 -
Have you read any of MSE's articles metioned at the top of each page?what is the distance selling regualtions please? also can i ask how you know the payment is no longer pending? i also made the purchase on sunday but having spoke to natwest today the advisor said the payment could remain in pending for months? the natwest fraud helpline is useless! they dont even ask any details about the fraudulant site, if the purchase was made on a debit card they are simply uniterested
Try reading MSE's Consumer Rights article for information about Distance Selling Regulations.
For more details on DSRs, this OFT guide is good.
For debit card chargeback, read MSE's Debit Card Chargeback article which has been mentioned in this thread more than once.
Just one sentence from there...It's worth noting most bank staff don't really know about this procedure, so you may need to explain it to them.0 -
just to confirm - the bank told me the pending payment couldnt be stopped regardless of whether i closed the account or cancelled the card, as technically the funds had left my account (with my authorisation) and were awaiting a request from the website to accept them - and that i could only open a dispute 15 days after the payment had actually been taken by the company.
I checked my online banking this morning as i have been several times a day since making this purchase and the funds were available again in my account - i immediately contacted the bank who checked their screens and reported no current pending transactions and it was at that point that i cancelled my card. In cancelling my card the understanding i have is that if the company attempt to take the money again in the future the details they have will no longer be valid and their request will be declined. hopefully
however i may go into the bank on the advise of a previous poster and just double-check that this is accurate.
the distance selling regulations - simply put i suppose it entitles you to change your mind about buying things (eg online in this case) - and entitles you to a refund. i am sure you have to do it within 7 days!!!! there is loads of info on this site that you will find useful - it will explain it a lot better than i could!!!0 -
Have just called my bank after worrying for last 4 days since purchasing ipad on sunday funds had been pending however bank have just confirmed that payment is no longer pending and they have either listened to my 4 e-mails to cancel my order (nhsdiscount that is) or just not taken money thank god am sooo relieved as felt so silly, the lady at the bank did also say that even if you pay on debit card and no product or refund after 15 days they can claim back funds for you good luck to everyone else hope your outcome is as good as mine X
I cancelled my card yesterday and now payment is no longer pending?? is this related dont care as long as they cant get their hands on my very hard earnt cash as am also an NHS employee X0 -

I rang the dispute line today at Lloyds bank and all they said was that I have to wait 15 days before i can open a dispute.
In regards to closing my account/cancelling card/freezing card, is it the best thing to do.
Has anyone actually cancelled their card, check their account maybe an hour or so later and has seen the pending payment removed and your balance is back to what it should be?
If closing your account actually works then I will do this tomorrow.
BUT!
What if you close your account and the money still goes out?0 -

Having purchased an IPAD on Monday 12th my payment is still pending. I have spoken to my Credit Card company this morning and they have advised that if no payment is called for by Wednesday next week the payment will drop off the system and they can't recall it.
The advice they gave me was to sit tight at the moment, even if the payment leaves my account as long as I don't try to cancel the goods they will be able to reclaim the money after 30 days.
They did give me a telephone number that was logged next to the transaction this was 01895 876500. I have tried to call but the number is out of service, no surprise there !!
Just going to keep my fingers crossed that the transaction stays pending !!!DFD - 10.09.2020. DMP Start Date 10.10.15 .

Let me know how you get on, best to go in branch. When it happened with me payment was pending but hadn't been taken out. When i closed my account the crooks couldn't get the money because the account didn't exist anymore.
You should be ok Thistle if the amount isn't pending anymore, just make sure thats the case. Only when money is pending but not been lifted is when closing your account is useful. If its no longer pending you should be ok but keep your eye on your account.
I was raging with my bank at the time as i was giving such poor advice, spoke to 7 different people and was told 7 different things, and ran up a £40 phone bill in the process. Luckily i listened to my own instincts and went into branch and closed account next day, and stopped fraudsters getting there hands on £800. If i listened to Bank Of Scotland customer service i would be £800 down, i was raging with them at the time but thankfully i took the right action.
Good luck people.0 -
Just checked my bank and the balance is back to normal. No more pending payment. All seems well! Just going to go into my bank today and cancel my card and order a new one just in case they try to take it at a later date.
The NHS Discount website went down last night so that might have something to do with it. All payments might have been reversed now.
Update: The bank said its pointless cancelling my card. The company could still take money somehow.0
