I have been in touch with CAB re mis-sold contract, they in turn reported my complaint to Trading Standards, as it is not possible to contact trading standards direct.
My local Trading Standards Office telephoned me this afternoon to discuss the situation.
It was an interesting conversation regarding legal action.
I am told miss-selling is a criminal offence, which is dealt with as a criminal case and not for civil action.
Civil action has to be brought on the grounds of misrepresentation and breach of contract.
She also suggested requesting tapes of the conversations when renewing contracts, I believe others have requested these already and drawn a blank?........I haven't personally though.
I also mentioned the difficulties in getting any dialogue from Orange having requested where to serve Court papers and which company to serve them on!
I had searched and found it all too unclear
She agreed and was totally unimpressed! Eventually she had to ring off and call me back while she searched and eventually found them.
I have just had a meeting at my local CAB - they are referring it to my local county trading standards office, and also confirm this is miss representation, breach of contract and probably illegal. I have been told to wait for trading standards to call me.
I suggest everyone does this to hold EE to account.0 -

I had my letter this morning.
I'm going to rent my line from Orange and keep receiving free broadband. I've read lots of posts on different sites and I don't understand why people are getting in such a lather about it. You already rent your line (from someone) and don't pay for broadband. Nothing changes only who you rent your line from.
If you change broadband providers you'll still have to pay line rental and then have to pay a monthly fee for your broadband.
If you're happy with the service stay with Orange!!!!0 -
It would help if Orange would listen and investigate individual complaints and follow their own codes of practice!
Actually my solicitor and CAB assure me that the fact EE have not listened or dealt with my written complaints, and are in breach of their own procedures - just plays into my hands in court. And everyone else.
I am also informed the cut off is irrelevant - the letter they sent saying BB ending on 15/10 is what is relevant, a court would be fully understanding why i moved my broadband when in receipt of such a letter.
There is nothing complex here at all - except EE's refusal to deal with it or accept their error. Legally its a win position for all except EE - according to solicitors, Ofcom, Trading standards, CAB and everyone everywhere else!0 -

I think you miss the point. Even branded as free, we are still paying for broadband within our mobile bundle. I could go and get the same mobile deal cheaper and pay for broadband with another company.
I chose to be loyal to orange each time i upgrade as the broadband is included but im not being pushed into paying for line rental with 2 companies just to still get free broadband.0 -

Well let me educate you....I have just started an 18month contract with Plusnet for my landline. So I am tied into that contract and can't just jump to Orange landline without penalty.0 -
Unfortunately, the letters are not clear either.
The first said 'if we don't hear from you, your broadband will stop working on...' The second letter 'if you don't get in touch, unfortunately your broadband will stop working on...'
So broadband will stop working if we don't get in touch with Orange?! Are these letters intentionally vague and ambiguous?
The cut off date may or may not be relevant. A court will certainly be understanding of all the facts. The Judge is very helpful and the process is informal as it can be. You only need to prove your case on the balance of probability.
If Orange do actually defend their case at a hearing, they may raise legal arguments for a Judge to rule on.
Fitz I cant help but feel that every time i post something factual from solicitor or CAB you feel a need to cast a doubt in peoples minds. I think you would concede that CAB/Trading Standards/ Ofcom/Solicitors might know a bit more about this than your good self!0 -

I am glad that you are happy with Orange, I am also glad that you are happy to pay Orange for your line rental.
I am not happy to move my line rental to Orange, why you may ask ?
They are more expensive than BT as I pay a year up front and get their line rental for £10.75 per month.
I renewed this in June and therefor I am in contract with them - I understand that now Orange are offering some money to assist in buying out your BT contract but here lies one problem - I trust BT, having dealt with them for years & always had good service - I do not trust Orange. I should add I have also dealt with them for many many years.
I use call divert regularly and I think this is a service Orange are unable to offer.
All I want from Orange is for them to supply me with what I was sold by them - broadband for free with my mobile contract. I would accept this being limited to the end of my existing contract - even though I have always been told it would be free for life or until I was no longer on a qualifying pay monthly mobile contract.
If they are not willing to do this I will take them to court.
So you see IceCube, it may be straight forward for you, for me and many others it is not quite so simple.

So you should have waited then - you might have got a better deal at the 11th hour!
For many of us there is only one deal - and its the correct legal deal - Orange EE miss sold upgrades and as such we have the right to cancel our mobile contracts at no cost to ourselves. The fact that they wont discuss this is about to become irrelevant as many of us will be in small claims courts proving this shortly.
They are just dragging it out to maximize the line rental take overs via people like yourself - then they will cave in and abide by the law - and we will have justice.[/QUOTE
