That is one of the reasons for my reservation for buying out your mobile phone contract before an actual court hearing.
If Orange can prove that there are in fact two contracts, one for mobile and another for broadband, they may succeed in their argument they are not in breach of your mobile contract and only in breach of your broadband contract.
So your claim for costs for another broadband provider would succeed but your costs to buy out your mobile contract fail.
Obviously these are legal issues of contract law, which others including experts can give opinions only, but it is for a Judge to decide on the evidence presented at Court.

Having sent a tweet to Orange Helpers and having a useless answer back i thought i give them something to read, then they told me the link didn't work, lol. So I've sent it again

Heres something interesting, a friend of mine has had a call in reference to his £5 Broadband deal he has trying to sign up his line rental also....
I have been waiting for three weeks for a call back and received none, but he gets an unprompted call in relation to his....
Anyway here's the interesting part, the fiber packages are launching end of Nov and will be priced at £10 pm for speeds of between 30 and 50 meg.... No wonder they want to tie us all in before then!!0 -
finally got my call back from so called "special team". or in other words some who said she was a supervisor from a company outsourced from orange. first off she was reluctant to offer anything... then mentioned she would buy out my bt line rental at £14.50 a month for remaining 9 months.
I told her i dont want line rental with orange after mis selling and gave her two option's.
either half my current £35 a month mobile deal or allow me to cancel my mobile contract.
was told i would received another call back in few days from a mobile team as they only deal with broadband.
Has anyone been able to cancel their mobile contract before it ends yet?. be interested to know.0 -

If the Orange helpers are reading this, please tell me if I'm going to be cut off.
I still haven't heard anything even though I have approached them!!

For those that are prepared to wait longer and closer to their apparent cut off dates, Orange may well come up with a better offer. Watchdog may force their hand?
First it was up to £50 to buy out existing line rental contracts. Then later changed to up to £100. Then following the Ofcom complaints, the material detriment offer and switch to only a 12 mth agreement and not 18 mths.
So the terms are improving! Orange may give you a 11th hour offer before your cut off (to not be in breach of contract), to keep your free broadband until the end of your mobile contract (without switching line rental!)
So you should have waited then - you might have got a better deal at the 11th hour!
For many of us there is only one deal - and its the correct legal deal - Orange EE miss sold upgrades and as such we have the right to cancel our mobile contracts at no cost to ourselves. The fact that they wont discuss this is about to become irrelevant as many of us will be in small claims courts proving this shortly.
They are just dragging it out to maximize the line rental take overs via people like yourself - then they will cave in and abide by the law - and we will have justice.0 -
