    Others may be holding out for some mega compensation, but for me life's too short for all that! :)

    Not looking for compensation;

    A) Honouring of my mobile contract to completion (March 2014)

    B) Penalty free release from my mobile contract

    Ive just had a call from the special team. I have to say the caller was lovely and I was offered a credit to my account which would cover the difference between what it would cost me to stay with BT and to move to Orange. I dont trust Orange and certainly dont want to be stuck with a long contract with them. Im done with them as soon as my mobile contract is up unless they free me sooner. I declined her offer and she was apologetic for what was happening. She confirmed my cut off date was the second one id received which is the later date. She also confirmed it had been extended because id not come to a decision to go to Orange and id also not requested to leave. She confirmed that this wouldnt keep happening though and that I would be disconnected on the date given. I confirmed I would not be buying out of my contract as she did ask me about this. I said id ride it out and see what happened and go from there but there was no way id be staying a customer for a day longer than I had to and the only options were for them to allow me to leave my contract with no cost to myself or for them to cut me off and breach my contract and I will then take further action as by then they will have definitely mis sold me my mobile contract. She said she would try to pull the recording of my call where I was offered the continued free broadband, this was around Feb 2011. The next step is that the mobile team will call me with regards to me being missold, no idea when this will be though. Their number wasnt witheld and I have it now so I shall just call back if I dont hear in a couple of weeks.

    They really shouldn't be looking at this case by case, everyone's situation is different, they should just be honouring the contracts! Does anyone remember signing one contract for their mobile & another for their broadband all those years ago?

    We didn't!...........for those who have the orange router.........definitely no BB contract was signed, I have the original paperwork and agreement.

    Absolutely! And no, I don't think I ever 'signed' a contract as they took over from Wanadoo so I never had a specific contract with Orange, they just took it on.

    I forgot to mention above, i also lose my free evening and weekend calls but they aren't even mentioning that!MissB

    I keep forgetting about that too! which makes their 'offer' even less attractive lol

    I never signed a contract either, I was inherited from freeserve/wanadoo as well.

    There are a couple of 'fights' for justice going on here - those that are saying 'free broadband for life' and sticking to that and those like me who ask at every upgrade will the free BB continue for the life of that upgrade.

    I also think that those who asked if their recent upgrade would have free BB for the life of the upgrade have a verbal contract that was miss sold -

    Landline costs - when doing the maths don't forget to factor in the cost of calls and any additional features you use like caller display, call divert etc - you may find what was included in your BT price is considered an extra at extra cost elsewhere.

    Although you may not sign a contract, such as telephone or online sales of products and services, when you subsequently receive by letter, the terms and conditions from Orange in writing, (or advertised on a website) in contract law it is deemed that you 'accept' them.

    To not accept them, you would have to have raised the issue at the time. That does not mean that you accept any unfair terms or indeed, any terms that breach any regulations.

    The terms would have to be fair and comply with relevant law, eg. sales of goods act.

    Would you agree with my solicitor that a verbal contract is a contract just like a written one, specifically for those who asked if their recent upgrade would have free BB for the life of the upgrade and were told yes?
