Did they not keep to their word then? what extra were you charged? was it on a redemtion basis?

They promised that I would be sent written detail, and it has not arrived. They said the existing two contracts would run to their natural end and then the two new contracts would commence and I learned that the two new contracts had been activated on the day that I had the conversation.

When I called their general number to ask about my final cashback on the existing contracts they gave me information that conflicted with what the the retentions guy had told me. The girl referred to the existing contracts as though they were 18 month contracts when in fact they were 12 month contracts.

All of this added up to disaster in my mind. I am a naturally cautious person where contracts are concerned and I wont sign or consent to anything until I've read the small print. I pointed this out to the retentions guy who assured me that I would receive a written contract. I informed him that if I didn't receive the information I required that I would be speaking to him again in order to end it, and this is what I did. He did provide some information in emails, however, that information was not comprehensive enough for my liking and I noted that his emails to me contained a disclaimer to the effect that anything written in the email did not constitute a contract. A wholly unsatisfactory situation and one with which I was determined not to dally.

I would have no hesitation in bringing court actions in order to settle the matter should that prove necessary.
  • My 12 month contract ends with them in August and I'm not sure I want to remain with them after all I've read on this thread. I think my tactic is going to be to demand something totally outrageous and see if they bite, if they don't no problem, I'll just shift out of there.

I say 12 month contract, but after some of the posts I've read, it may be 18 months, it may be 24 months!!

If your contract ends in August and you think you might want to accept any offer they make I would call them now, ie hopefully you will still have in excess of 30 days to run on your existing contract. Make a note of the name of the retentions person you speak to, and get his/her telephone number, and note the date and time of the call. Tell the person that you will not accept any offer unless it is written down. If they wont write it down you need to harbour some suspicion.

In about three days time call their general number, making a note again of the detail above and ask the person what is the status of your contract. This is so that you can check that your existing contract has not been changed as a result of your conversation with retentions prior to your receipt of a written contract. If it has changed you should be suspicious that you have not and will not receive written detail of the proposal.

If it gets close to the 30 day notice period and you haven't written detail of the contract you could then call them for a DRN and then you can end the existing contract without further ado.

As soon as I get to 60 days before the contract anniversary I write a letter of notice to cancel at the end of the 12 months. I don't call them or contact them any other way. If I don't receive written notice 7-10 days after I send the letter I call cpwO2 and check they have received it and that the contract will end precisely at 12 months. I then make sure I receive payment for the usual overpayment on the last bill after the 13th statement date. That is what I advise all my people to do - and they have done that (with the 2 exceptions who "upgraded") without any problems. If they do speak with me at any point and start spouting the 33 days and the need for a "disconnection code" I tell them what to do with it and put the phone down. When they treat customers like idiots they deserve the backlash and I won't play any games with these people - either with cancellations or cashbacks.

Thanks for the advice Steve, unfortunately, my contract expires on the Aug 15th so I may have missed the boat. I renewed the contract with them at half price for the last 12 months, but no new phone. What do you think the best thing for me to do is? I've seen some good offers on Orange that are tempting.

Here is a prime example of a CPW nonsense. This current offer of theirs appears to be for a 12 month contract. Yet when you click on "more" under the title "offer" in the offer summary section on the right hand side of the page it says that you need to send the 6th, 10th, 14th and 18th airtime bills in order to obtain your cashback. How can this be, since the contract is supposedly for 12 months in the first place?

Has anyone taken CPW O2 up with a cashback retention deal, and NOT had any problems ??

    Thanks

Only you can decide whether or not you feel comfortable with what they have told you and only you can decide whether you have enough hard evidence to deal with them if the new deal isn't as you were told it would be or as you believe you were told it would be.

If I was you, in the absence of anything written, then I can assure you that I would cancel.

To my mind, written contracts for mobile phones ought to be mandatory.

You've helped me make up my mind on this. I'm going to ditch those losers and go with Orange. They just seem a bit too dodgy for my liking. And I don't have the energy or time to have to chase them up for any omissions in the offer they may suddenly come up with.

As you rightly point put, it's the time and energy it takes to unravel it all if it isn't as you believe it will be. This is precisely why I insist on the full detail of the offer being in a written form before any contract starts. That way, one can say no before it all starts. It is far easier to say no before it starts than it is to unravel it after it has started.

To my reasonable mind, if an offer is as good as they purport it to be then any decent company will have no hesitation in stating the full and unambiguous detail of the offer on paper. I don't care how hurt these guys feel when I appear to question their integrity as I'm more interested in minimsing any contract hassle. Don't forget, when you deal with Andy or Amy from CPW that they may not be there tomorrow, but your contract with CPW will be.
